"Know all men by these presents that I, JONATHAN BURSON of the county of Preble and state of Ohio, being advanced in years, and weak of body, but of perfect sound mind and memory and understanding and calling to mind the uncertainty of life and certainty of death, and being desirous of settling my worldly affairs before my decease, have thought proper for that purpose to make and publish this, my last will and testatment in the manner and form, following that is today - It is my will in the first place, that my body should be buried in a place and decent manner at the discretion of my executors, hereafter named and after my just debts and funeral charges are paid, the residue of my property which it has pleased devine providence to bless me with, I do give, devise and bequeth as folows -
Item, I give and bequeath unto my beloved wife, REBECCA BURSON, all my personal property, consisting of livestock and household furniture as her own, forever, to be disposed of by her as she may think proper and whereas my real estate or landed property consists of the Northeast quarter of Sec. #10, Township No., section and range no. one east of the mouth of the Great Miami River as also the northwest quarter of sec. #11, twp. #7 and range #1 east of the meridian of the mouth of the Great Miami River, as will more fully appear by my deed for the same and as the above named quarters be adjoining each other, I have thought proper to give anbd devise the same as follows -
Item, I give and devise unto my son, LEVI BURSON, his heirs and assigns forever, sixty acres of the above described tract of land off the west side of the above named northwest quarters, as to include the environment where he now resides.
Item - I give and devise unto my son MOSES BURSON, his heirs and assigns forever, sixty acres of land next adjoining his brother Levi's land - whereas, my son BENJAMIN has always lived with me, and it is my desire that he should take care of his mother until her decease, I have thought that he was entitled to a larger share of my estate than my other children.
Item - I give and devise unto my son, BENJAMIN BURSON, his heirs and assigned forever, eighty acres of land next adjoining his brother Moses' land - and the residue of my before named tract of land, I do hereby dispose of as follows,
Item - I give and devise unto the children of my deceased son, SOLOMON BURSON, their heirs and assigned forever, thirty acres of land to be laid off to them by my executors, or in lieu thereof, forty dollars at the discretion of my executors, the money to be paid them in one year after my decease, by my executors.
Item - I give and devise unto my daughter, ELEANOR SYBOLD, her heirs and assigns forever, thirty acres of land to be paid off to her by my executors, or in lieu thereof, forty dollars to be paid thereof in one year after my decease, by my executors at the discretion of my executors.
Item - I give and devise unto the children of my deceased daughter, MARY LEWELLEN, her heirs and assigned forever thirty acres of land to be laid off of to these, by my executors, or in lieu thereof, forty dollars to be paid these in one year after my decease by my executors at the discretion of my executors.
Item - I give and devise unto my grandson, PHINEAS SEBOLD, his heirs and assigns, thirty acres of land to be laid off to him by my executors, or in lieu thereof forty dollars to be paid him in one year after my decease, by my executors at their discretion.
And as it is my will that if my sons MOSES, LEVI and BENJAMIN shall well and truly pay unto my above named legatees, viz the children of my son SOLOMON, my daughter ELEANOR, the children of my daughter, MARY and my grandson PHINEAS SYBOLD, the sum of forty dollars each within one year after my decease, then and in that case, I do hereby devise unto them in proportion to the money paid by each of the abo e named, land and the above devise of land be _____ and of none affect, but if my above named sons shall fail to pay the above named legacies of forty dollars to each of said legatees within one year after my decease, then and in that case, it is my will that they should inherit each, their thirty acres as if the forty dollars has not been mentioned and it is further my will that if my beloved wife should decease before me, that my personal property should be divided amongst my lawful heirs equal share and share alike, and lastly, I do hereby constitute and appoint my sons, MOSES BURSON, LEVI BURSON, and BENJAMIN BURSON to be my sole executors of this, my heretofore made, retifying and confirming this and no other to be my last will and testament. In testimony whereof I, JONATHAN BURSON, to this my last will and testament, set my hand and seal, this fifteenth day of the fourth month in the year of our Lord, One thousand and eight hundred and twenty-six.
