re Enoch's Will:
In 1852 John Littleton died and William G replaced him as the executor of Enoch's estate. The case was finally settled in 1858, however that wasn't the end of the matter. In 1860, William discovered that when he bought the land from the other heirs he had failed to record the deed. He now had to go back to the heirs, some more of whom had died and try to prove he had paid for the land and should have a quit claim deed. Charity Wills had been declared insane and was represented by a Commissioner, John B. Miller and Mazariah Thomas was still alive. William brought a case to the Loudoun Court asking that the other heirs be required to sign a quit claim deed. The case dragged on until 1871, when Elizabeth was finally free of Thomas and married to John Costello. Costello fancied himself somewhat of a legal mind and insisted that Elizabeth had never been paid for 328 acres, 3 roods and 24 perches at the rate of $27.50 per acre. To get the case settled William had to pay again. Would love to find ANY land in Loudoun county today for $27.50, or even $2750 per acre!!!
