This the last will and testament of John Daniel of Buchanan Bounty Missouri in Platte Township. I, the testator have lived until old but in as good health as common and my mind strong and proper. I think proper to regulate my worldly affairs as follows, setting all former wills aside. In the name of God ______
First of all I desire that my body be decently buried according to my manner and custom of living and all funeral expenses be paid.
Second, I will all my just debts be paid.
Third, I give and bequeath unto my beloved companion, Elizabeth Daniel, the north east quarter of section no. twenty of Township fifty-five of Range no. thirty-three, the place on which I now reside containing one hundred and twenty acres also the west half of quarter section no. seventeen Township fifty-five of Range no. thirty-three for the said Elizabeth Daniel to have and to hold with all the appurtenances thereunto belonging undisturbed whilst the said Elizabeth keeps her name Daniel or remains my widow the above named land and premises.
At the end of said Elizabeth's widowhood or natural life for my son, James T. Daniel to heir the same lands I also give and bequeath unto the said Elizabeth all my household and kitchen furniture, two work horses, two set of year two milk cows, two ploughs, two asses, and all of my hogs subject to the following conditions.
If the said Elizabeth marry, the foregoing personal property shall revert to my estate to be equally divided between my three sons William, Owen and James Daniel. If the said Elizabeth shall not marry at the ___ of her life the above named personal property shall be equally divided between the named sons.
I give and bequeath unto my son Henry H. Daniel the south east quarter of section nineteen in Township fifty-five of Range thirty-three containing one hundred and forty acres.
I also give and bequeath unto my son William Daniel the north west quarter section no. twenty of Township fifty-five of Range thirty-three.
I also give and bequeath unto my son Owen Daniel the north west quarter section nineteen of Township fifty-five of range thirty-three, also the south half of the south west quarter of section twenty one in Township fifty-five of Range thirty three.
I also give and bequeath unto my son Warner W. Daniel the east half of quarter section twenty eight in township fifty five of thirty-three.
I also give and bequeath unto my son John Daniel Junior five dollars over and above what I have give him.
I give and bequeath unto my grandson Francis M. Williams five dollars.
I give and bequeath to my grandchildren, the heirs of Jeremiah Daniel, the sum of five dollars each over and above what I have give the said ___.
I give and bequeath unto my six daughters, Elizabeth Wise, Malinda Hite, Sarah Maddon, Nancy Tinsley, Melitty Madon, Emeline Clanton, Two hundred dollars each when my money is collected over and above what I have give each one.
I give and bequeath to my sons William, Owen, and James Daniels five hundred dollars to school them.
I appoint Henry H. Daniel and Warner W. Daniel Executors to my last will and testament in testation of the same I set my hand and fix my seal this the 23rd March 1850.

Biography
Owen Daniel, one of the representative citizens and substantial farmers of Platte township, Buchanan County, who resides on his well-improved farm of 236 acres, in section 19, township 55, range 33, was born on this property in a little pioneer log house 16 by 18 feet in dimensions, on May 28, 1840, and is a son of John and Maria(Hite) Daniel.
John Daniel, our subject's father, was born in Virginia and removed to Shelby County, Kentucky, at the age of 17 years. He owned slaves and property in the vicinity of Louisville prior to coming to Buchanan County, Missouri, after his second marriage, in 1832. He entered 160 acres of land for himself and claims for his children, and owned some 100 acres additional, which he purchased. At the time of his death, in 1862, he left money for our subject to use in obtaining a good education, but it was never applied to that purpose.
John Daniel was married three times and became the father of 16 children. His first
marriage was to a Miss Briscoe, and they had 13 children.
His second union was with Maria Hite, present home farm, at the age of 32 years. The two children of this marriage were: William, who joined the Confederate Army, was subsequently taken prisoner and later, after his release, was killed in a skirmish; and Owen, the subject of this sketch.
The third marriage of Mr. Daniel was to his sister-in-law, Mrs. Elizabeth (Briscoe)
Taylor, and they had one son, James, now a resident of Oregon.
Our subject was 12 years old when his father died.
