As with most families, Paul’s was hit hard by the civil war. Late in life, Caroline was unable to care for both herself and her even older husband. Dated 28 Nov 1892 while still of good mind, Caroline Hagler wrote a last will and testament witnessed by C. L. and J. H. Lemmond. No longer able to manage her affairs, on 7 May 1896, F. H. Wolfe was appointed by the court to receive and manage Caroline Hagler’s estate. He accepted about five hundred dollars with the records indicating little else of value except for a nondescript amount of property owned by Caroline. At the time of the court action, documentation states that Paul Hagler was 91 years of age and Caroline 87. Both were living with the recently widowed daughter Lydia T. Pusser. The court action arose from the death of Lydia’s husband and her inability to take care of both her parents and the large family. We are not sure when Paul died. However, dated 11 Apr 1899, J. A. Austin qualified as Administrator for the estate of Caroline Hagler deceased. Three items within a petition raised by the Administrator provides valuable information on the family:
3. That your petitioner is advised and believes, that under the will of said Caroline Hagler, the sum above named, . . . should first be divided into six equal shares as follows, to wit: - One share to the next of kin of Lindy Medlin, the deceased wife of Milas Medlin and a deceased daughter of the said Caroline Hagler; one share to the next of ____ Furr the deceased wife of C. F. Furr, deceased, and a daughter of the said Caroline Hagler: one share to Lydia Garmon wife of her codefendant, George J. Garmon, and a daughterof the said Caroline Hagler; one share to Ellen Cuthbertson, wife of A. J. Cuthbertson and a daughter of the said Carolina Hagler: and one share to Elizabeth Mullis a daughter of the said Caroline Hagler; and one share to Mary Ann Mullis wife of her co-defendant Samuel Mullis and a daughter of the said Carolina Hagler.
4. That Lindy Medlin is now dead and left as her children Luther Medlin, Joseph Medlin, Mary Smith, wife of her co-defendant Henry Smith, Martha Gardner wife of her co-defendant Wade Gardner and Hoyle Medlin, each of whom are over the age of 21 except Hoyle Medlin who is 20 years old.
5. That Lilia Furr is now dead and her husband C. F. Furr also died prior to the death of the said Carolina Hagler and she, the said ____ Furr, left surviving her as her next of kin __ C. Helms, wife of her codefendant J. L. Helms, L. Z. Simpson, wife of her codefendant Baxter Simpson, D. L. Furr, Paul F. Furr, S. A. Furr, and W. O. Furr, each of whom are over the age of 21 years except S. A. and W. O. Furr, who are aged 19 and 17 years. . .
6. That Lydia Garmon, wife of her co-defendant, Geo. J. Garmon, Ellen Cuthbertson wife of her co-defendant A. J. Cuthbertson, Elizabeth Mullis and Mary Ann Mullis, wife of her co defendant Samuel Mullis, each are entitled to sum of $____ as distributees of the estate.
