In the name of God, Amen. I, C. H. Orsburn of Alabama in the county of Dallas being mindful of my mortality do, this 13th day of March in the year of our Lord One Thousand, Eight Hundred forty-nine make and publish this my last Will and Testament in manner following. -- First I have heretofore given unto my Eldest Son Pleasant M. Orsburn to the amount of One Thousand Two Hundred and thirty Eight dollars. Also I have heretofore given unto my Second Son Jabez J. Orsburn to the amount of One Thousand dollars. Also I have heretofore given unto my eldest daughter Lyda B. Rountree, wife of A. M. Rountree to the amount of Eight Hundred dollars. Also I have given unto my Second daughter Mary Ann Orsburn a Negro Woman and her three children Mundy, Cahen and Chancy, and Nelson, a boy worth at the time I gave them Eight hundred Dollars + bed + furniture. Also I have given my third daughter Matila Ross, wife of Andrew J. Ross, to the amount of Eight Hundred Dollars. Also I have given unto my youngest Daughter Nancy Orsburn Two Negroes, Mariah a woman and Ezekiel a boy, at the sum of Eight hundred dollars, and bed and furniture. Also I have given unto my son Robert E. Orsburn two Negroes, Adeline a girl and Ben a boy, at the sum of Eight Hundred Dollars. Also I give and bequeath unto my grandson Lucius L. McCurdy, the son of my Daughter Narcisa, late wife of R. A. L. McCurdy, two Negroes, Malinda a girl and Jerry a boy, at the sum of Five Hundred and fifty Dollars, and after my decease the said Negroes to remain in the possession of my wife Catherine Orsburn during her life or until he arrives at the age of Twenty-one years, which ever may first happen. And in case of the death of my Wife, then her Executor to take them into his pofsefsion and if my grandson Lucius L. McCurdy should die before the age of Twenty-one years, the same to revert back to the Orsburn family.--- Also I give to my Wife Catherine Orsburn during her life all my Real Estate also all my personal property, (to wit) My Carriage Wagon horses and mules, cattle and hogs, and sheep and stock of all kinds and all farming utensils household furniture Bedsteads, bedding and other furniture. Also all the rest and residue of my estate both real and personal not herein given and disposed of to remain in the pofsefsion of my Wife Catherine Orsburn during her life and then after her decease, the Real Estate to be sold and the proceeds together with my personal property to be Equally and fairly divided among all my children + Grand Son Lucius L. McCurdy, with what they have heretofore received. If Mary Ann Rountree, the daughter of Lyda B. Rountree die without any heirs of her body then the share of her mother Lyda B. Rountree shall revert back to the Orsburn family. --- Also I do hereby constitute and appoint my Said Wife Catherine Orsburn Sole Executrix of this my last Will and Testament With full powers to act as such without being compelled to give bond or security according to Law. Signed sealed, published, and declared by the said Testator as and for his last Will + Testament in our presence, Who at his request in his presence have subscribed our names as Winefses thereto. The State of Alabama Dallas County Regular Probate Court 9th Day of April 1855 Personally came in to open court George C. Phillips one of the subscribing witnefses to the above and foregoing Will hereto attached and first being duly sworn saith on oath that he was present and saw Christopher Orsburn whose name appears thereto sign and did the same as and for his last Will and Testament and that the said Christopher Orsburn was of sound mind and [illeg] memory at the time of signing the same and that he has [illeg] together with John K. Campbell and Isaac Moore signed the same as witnefses at the request and in the presence of the said Testator and in the presence of each other on the day and year thereon written. George C. Phillips.
