In the name of God Amen I Elijah Pope of Halifax County and State of North Carolina being thro’ the abundant mercy and goodness of God of as perfect ______ memory thanks be to that adorable being but calling to mind instability of this my present transitory state of existence knowing that it is appointed for man once to die do make and ordain this my last will and testament and desire it to be received by all as _____. I give my body to the earth from whence it was taken I also give my Lord God from whom it originally sprang as for my burial I leave at the discretion of my dear wife
Item I positively order that all my just debts be paid out of my estate
Item I give and bequeath unto my son Jacob Pope a tract of land lying on the No side of Deep Creek containing one hundred and fifty acres be the ____ more or less as soon as he comes to the year of twenty one to him and his heirs forever
Item I lend unto my loving wife Uphami all the rest of my land during her life or widow and after decease or widowhood it is my desire that should be equally divided between my two sons to wit William Pope and Elijah Pope to them and their heirs forever
Item I lend unto my loving wife Uphami all the rest of my estate during her natural life or widow hood. My desire is that there should be equal division among all my children after my wife’s lifetime or widowhood to wit Jacob Pope, William Pope, Elijah Pope, Patience Pope, Penelope Pope, Sally Pope, Hardy Pope, and Charlotte Pope to them and their heirs forever.
Lastly I do constitute and appoint my friend Wm Whitehead Jun and my loving Uphami to be my whole and sole executors and trustees and empower my executors to dispose of my estate as they think best for the use of my children. I do ordain this to be my last will and testament: In witness whereof I have hereunto set my hand and affixed my seal this 14th day of December, 1794.
