The numbering depends upon who is called first Lord. The above genealogy has Henry (1375 – 1420 as first Lord Sinclair stating that he was the first bearer of the title in public documents. The book uses as a major source another book "Genealogie of the Sainteclaires of Rosslyn. Including the chartulary of Rosslyn by Hay Richard 1661-1735/6" (1835)

This book contains lots of the charters from the archives of Roslyn castle; mostly in Latin. The editor (can't find his name) of the volume suggests that Hay doesn't always translate or interpret these correctly but he supports Hay on his assertion that the Earldom unusually went to the youngest son. I did find one indenture dated 1419, on page 60 which uses the phrase Henry Earl of Orkney, Lord Sinclair and Niddersdale which is presumably the document that is being used as evidence.
Apparently Burke changed it's numbering for this title after the 1970 edition and if that is accepted by most modern authorities ; then that's probably right
More important is the paternity of Henry ( http://www.wikitree.com/wiki/Sinclair-181 )that matters. At the moment wiki tree has his mother correctly as Christine Sinclair but his father as William the Earl (ie William the younger) This according to the above source and elsewhere such as http://www.thepeerage.com/p2844.htm#i28440 is incorrect. These sources have his father as William of Newburgh (aka the 'Waster' ) the elder son who was declared incompetent but was still Lord Sinclair (the 2nd or 3rd depending on source)
