Gravestone shows just 1925.Wes was murdered by a man named Howard Smallwood. He was shot off his horse by a blast from an automatic .12 gauge shotgun (three shots were fired). The horse spooked at the blasts and bolted, dragging the body of Wes Yates about 300 yards before his boot got free of the stirrup. The murderer was never prosecuted and reportedly moved to Texas at the suggestion of the local deputy sheriff, Bob Caviness, who reportedly felt the killing was justified. Howard Smallwood was the husband of Hattie Smallwood, a woman of about age 25 who Wes had just visited. Reportedly, the Smallwood's were estranged and Mrs. Smallwood had entertained some of the area men. Howard warned Wes the previous month to stay away from his wife, but apparently Wes did not listen and paid the price.
