Archer was killed by his brother-in-law Marshall Farmer and Farmer's friend Alexander Boatright on 11/23/1828. It was the day of the funeral of Archer's father John Wingo and all had been drinking. When Archer would not give up the key to the closet where more whiskey was stored he was chased out into the yard, knocked down and beaten. He was taken home but died within a few hours, probably from internal bleeding. Doctors did several blood lettings which could had had a negative impact on his survival.

The court records in Amelia County, Virginia Court Order Book #36 lays out the case. A Negro slave in the Wingo household overheard the comments of Archer after he arrived home but was not summoned. The death was determined an accident but Marshall Farmer was required to give up his worldly goods to be sold and given to Archer's wife and family. He did not go to jail. He moved to Bedford County, Virginia and lived there until 1849 when he moved his family to Alleghany County (then Botetourt County), Virginia.
