Charles County Land Record Book G#3, 1756-1761; Page 428. Declaration of uses of recovery. Indenture made Jan 29, 1760 between Thomas Johnson Jr of CC, Gent, and Thomas Tawney, late of CC but now of St. Mary's County, planter, and Mary, his wife. Whereas, for the docking, barring, and extinguishing all estates, tails, and reversions and remainders thereupon, expectant or depending, in the lands herein after mentioned, sd Thomas Johnson, as demandant, did heretofore, at the request of sd Thomas Tawney and wife Mary, prosecute out of the high Court of Chancery his writ of entry cur desceisin en le post against them, sd Thomas Tawney and Mary, his wife, tenants, returnable to the last Provincial Court, whereby sd Thomas Johnson demanded against them, the Tawneys, a tract of land in CC called Shaws, being part of a tract of land called Wollaston Manor, sd part called shaws being divided from the other parts as follows: beginning at a cedar post at the end of 71 perches in the 2nd line of that part of the whole tract which is in the partition for one moiety thereof amongst Parceners, is called Poplar Point, & it is numbered one in the plat of the ad partition of the sd moiety, and running from the cedar post N 66 degrees W 232 perches to a locust post put down on making sd partition, then NE to the Cr and up the Cr till it intersects the last line of another post of sd whole tract which is called in sd partition Bateman and it is numbered in sd plat two at the mouth of Shaws Branch and with the sd last line of Bateman to sd beginning cedar post, containing 183 acres, to which sd writ of entry the sd Thomas Taney and Mary, his wife, did vouch to warranty thereof, and such further proceedings were thereupon had that sd Thomas Johnson, by judgment of the same court, did recover his seisin against the sd Thomas Tawney & Mary, his wife, of and in the demanded premises. Sd Thomas Tawney and Mary, his wife, recovered over in value whereby a common recovery of sd premises was had and suffered and executed. Now this indenture witnesses that, for the settling and declaring the uses of the sd common recovery and for the advancement of the children of the sd Thomas Tawney and Mary, his wife, it is hereby agreed that the common recovery should stand and be for the use of sd Thomas Tawney and Mary, his wife, during their natural lives and to the survivor of them during the natural life of the survivor, and after the death of sd Thomas Tawney and Mary, his wife, to the use of John Francis Taney, son of the afd Thomas Taney and Mary, his wife, and the heirs of his body lawfully begotten, and in default of such issue, to the use of Thomas Michell Tawney, son of the afd Thomas Tawney, Mary, his wife, and the heirs of his body lawfully begotten, and in default of such issue, to the use of Mary Eleanor Combs, the daughter of the afd Thomas Tawney and Mary, his wife, and the heirs of her body lawfully begotten, and in default of such issue, to the right heirs of the afd Mary, the wife of the afd Thomas Tawney and their heirs forever, provided nevertheless, and it is hereby agreed that it shall be lawful for sd Thomas Tawney and Mary, his wife, during their lives, by any instrument in writing, executed in such manner as other deeds by feme coverts of their inheritance are executed, to revoke the several uses herein before limited at the mere will of sd Thomas Tawney & Mary, his wife, and by the same writing or other instruments, to sell such quantity of estate as they shall think proper, and that the recovery shall inure. Charles County Land Record Book L#3, 1761-1765; Page 464. May 19, 1764 from Mary Taney of St. Mary's County, widow, to Henry Queen of St, Mary's County, Gentleman. A common recovery was heretofore had of the lands hereafter described, and the uses of the sd recovery, by CC deed dated about Jul 29, 1760, whereby Thomas Taney, in his lifetime, and the sd Mary, limited and declared to the use of them, the sd Thomas and Mary, during their natural lives, and to the survivor of them during the natural life of such survivor, and after the death of them, sd Thomas and Mary, to the use of John Francis Taney, son of the afd Thomas Taney and Mary, his wife, and the heirs of his body lawfully begotten, with divers remainders over also a clause of revocation in the same deed, empowering either sd Thomas or Mary to revoke the former uses and to sell and dispose of the lands. Sd Mary Taney has agreed with sd Henry Queen for the absolute sale of sd land, and wants to revoke the former uses and make a conveyance to sd Henry Queen. Now this deed witnesses that sd Mary Taney, for 230 £ sterling, sells to sd Henry Queen a tract of land in CC called Shaws, being part of a tract of land called Wollaston Manor, sd tract of land called Shaws being divided from the other parts of sd tract by the following: the 2nd line of the whole tract which in the partition of one moiety thereof a parceners is called Poplar Point, and is numbered one in the plat of sd partition of sd moiety, thence to the Creek [unnamed], thence to another part of the whole tract, which is called, in sd partition, Bateman and is numbered in the sd plat 2) at the mouth of Shaws Branch, containing 183 acres of land.
