William Simpson KEIR did not sign a will, even though it had beenprepared. The following is a letter written by his sister, Catherine
KEIR, sent to his living siblings and to the children of his deceased
siblings (not dated, but sent 18 May 2005)
"WILLIAM KEIR'S ESTATE
Following the death of your late uncle William, who as you probably
know lived with me in Banton, I have been endeavouring to deal with
his estate.
William had been very poorly for several years and although I had
arranged for a local Solicitor to make up Wolls for both of us,
leaving each estate to the other, William was never well enough to
arrange to visit the Solicitor and have his Will signed. Although it
was his intention that his estate should be left to me, as we had
lived together for so long and I had nursed him and looked after his
personal affairs for so long, I have been advised that on his death
his estate can in fact be claimed by all his surviving brothers and
sisters, and, to a limited extent, also by the children of any
predeceasing brothers and sisters.
I have been advised that in order to wind up William's estate, I will
need to obtain written confirmation from each beneficiary to the
effect that if he/she has any claim to any part of the estate, they do
not wish to make such a claim and would relinguish such claim in
favour of myself as William's sister.
As I understand that everyone in the family would generally
acknowledge that William's wishes were to leave his estate to me, and
assuming that you are happy to accept this, can I ask you to complete
and sign the duplicate copy of this letter and return this to me as
soon as possible, in order that I may take the necessary steps to wind
up the estate.
