Sarah David Smith

"From time to time, deeds of gifts from both families had been made in trust for Sarah Terry, and records of such instrument, one from David Smith and one from Nathaniel Terry, of Kentucky, the father of Joseph, were necessarily filed in Hinds County (Mississippi) since they were gifts of slaves. (Hinds County, Mississippi Deed Book 1-40. David Smith to Josiah Smith, my son, a negro woman and child in trust for the use of my daughter, Sarah D. Terry, not to be applied to the payment of any debt contracted by Joseph R. Terry, her husband, April 1822 (This was acknowledged in Logan County, Kentucky by George B. Crutcher, a witness, July 1822. J. C. Smith accepts afsd trust. The Smiths did not come to Mississippi to live until late in the fall of 1822). Deed Book 1-41. Agreement. Nathaniel Terry, of Todd County, Kentucky to Josiah Smith, a negro named Charles, for the benefit of my daughter-in-law, Sarah D. Terry, during her lifetime and then to her children. November 12, 1825. Signed. Witness: William Watlington. Josiah C. Smith accepts trust. Acknowledged by witness, 9 December 1825.) Josiah Smith, then guardian of his sister, Sarah Terry, bought a place for her in the town of Clinton, about eight miles west of Jackson, which many settlers chose as a place of residence. The Terrys apparently settled there in 1826. (Todd County, Kentucky Deed Book D-95. 7 August 1825, John W. N. A. Smith, trustee for Sarah Smith, Joseph R. Terry and Sarah Terry, of Todd County, Kentucky to George R. Hopson, of Montgomery County, Tennessee, for $720, 169 acres, part of a tract, in trust for Sarah by her father. Signed by the three. Witness: Lewis B. Fort, J. B. Allenworth, George Isbell.) The next year (1827), their sixth child, Aurelius Josiah, was born, three of their sons having died in infancy." "Josiah C. Smith, third son of Major David Smith, began the practice of law in Vicksburg, Warren County, before 1828. In 1830, he married Susette Johnson of Hinds County. (Raymond, Hinds County, Mississippi Minute Book 1. Marriage Licenses, page 104. Josiah C. Smith and Susette Johnson. George B. Crutcher, surety. May 30, 1830.), probably the daughter of Benjamin Johnson, a neighbor of the Smith family. She died the next year after the birth of a son, Benjamin Josiah. Placing the baby in the care of his sister, Sarah Terry, who had another new son, Josiah turned to his law practice in Vicksburg, selling the home he had bought there. He had established a creditable standing in his profession when he died of Asiatic cholera in the epidemic of 1833. In the inventory of his estate, the list of classical works, besides the number of books in his law library, indicate that he had received a good education. In 1829 he sold the Clinton property for his sister, Sarah Terry, and she and her family went to live on land that had been granted to her near her father's place. Besides the loss of her brother, Sarah Terry was having other troubles about that time. Joseph Terry [her husband] had opened a gambling establishment near the Capitol, thereby breaking a solemn promise to her. Because of this they had separated. Benjamin F. Smith had gone to Texas from Missouri early in 1833 and had bought a plantation on the Brazos River. Hearing of his sister's trouble, he offered her and her children a home with him.
