"Action by John D. Martin against Daniel F. Martin to determine title to land. From a judgmen t for defendant, plaintiff appeals. Reversed. Pryor, J. Valentine Martin, being advanced in years and unable to support himself and wife, conveye d a small tract of land to his son John D. Martin, in consideration that he would support th e two old people during their lives. They lived together as one family under this arrangemen t for four or five years, when John, the son, as the weight of the testimony shows, neglecte d his father to such an extent as caused him to complain; resulting in this trouble, in John' s handling back to his father the deed, and his leaving the premises. It is proper to say tha t John's version of the trouble is that his father wanted him to support his sister, and on h is refusal he left the place with the father in possession. The father lived for seven or eig ht years after this, and, being under the impression that the redelivery of the deed reinvest ed him with title, executed a deed to his son Dan Martin, based on a like consideration. Th e last son, Daniel, supported his father comfortably for seven or eight years, and after hi s father's death John, to whom the first deed was made, brought his ejectment to recover th e land. The case was transferred to equity without objection, and the deed to John canceled . We think this was error. John had kept his father for several years, and, while he surrende red the deed to his father, it did not divest him of title. The consideration expressed in th at conveyance, however, was discharged by the appellee, his brother, under the deed made to h im, and made under the belief that the surrender of the first conveyance by John restored th e title in the father. That he did support his father is evident, and, as all these parties a re in a court of equity, the chancellor should allow the appellee the sum of $50 per annum i n addition to the rent of the land for the time he supported his father, and subject the lan d to its payment. "The family told me that in late 1909, John was trapped by a felled tree, which pinned him against the ground at the neck. It cut off air flow and by the time our grandfather David found him (he was 16 at the time), his father John had received irreversible brain damage. David pulled the tree off his father, but his father laid there comatose. Great grandmother Lucy and the boys (Creed Dalton, James Parker, little Samuel) all pulled their father back to their homestead at Harris Road, but he did not recover. Lucy and the boys, and John's own father and mother,(George Valentine Martin and Rachel Ann Keck), who lived nearby, took him to the hospital in Corbin. John did he come out of the coma but was unable to care for himself. He was transferred to the Lunatic Asylum in Danville, about 80 miles away. John's sister Ellen tried to take him out but the administration would not let her, even though, and Lucy could not care for him and the boys. Lucy died in 1934, but John remained at the hospital/asylum until his death in 1953. Now I know I was named after him! The farm they owned was 600 acres, large and John was buried on his own farm, with Lucy. Our grandfather David is buried right next to his father." (Ian Martin.)
