17 Oct. 1875, Samuel BERRYMAN VS Dudley BERRYMAN, Dillard BERRYMAN, Samuel BERRYMAN, Francis BERRYMAN, Wm. BERRYMAN, Mary JOHNSON and Armstead JOHNSON her husband, Serelda SAMS and Chesley SAMS her husband, Armilda BERRYMAN, Eliza A. BERRYMAN, Thomas BERRYMAN, James BERRYMAN, Emaline BERRYMAN, Elizabeth BERRYMAN, and Docia BERRYMAN. On Aug. 1871 James BERRYMAN departed this life intestate leaving debts. Mary JOHNSON and Sarilda SAMS his heirs of when Docia BERRYMAN is since decedent widow and the other debts. His children the debts., James, Emaline, and Elizabeth being infants. Plantiff (Samuel BERRYMAN) and James BERRYMAN deceased were brothers and the only heir of JOHN BERRYMAN their uncle who died 1857, possessed 78 acres of land in Estill Co bounded on the north by Samuel BERRYMAN, east by George CLEM, south by Wm. KING, west by James BERRYMAN, deceased, and whose widow Betsy BERRYMAN, she died (1872 April). After John BERRYMAN died they divided land except 27 acres as widow's power for Betsy (Betsy KING, wife of John). A swap of land, James got 23 acres of the dower, was to give Samuel 8 acres of the first divide." (Estill County, Kentucky, Circuit Court Records 1804 - 1928.)

(NOTE FROM RALPH TERRY: From this court record, it was determined that James and Samuel BERRYMAN were John's nephews, as John's sister Winny (who never married) was the mother of James and Samuel.)
