Peter was mentioned in Will of father, John DeWitt dated 17 Oct 1835.
DEED: Deed Book 21, pg 178 Nelson Co KY (written from copy of Will) - This
indenture made and entered into This Seventeenth Day of Oct in the year of Our Lord One Thousand and Eight hundred and Thirty Five Between Peter DeWitt Heir at Law of John DeWitt of Nelson County State of Kentucky and Elijah Middleton and Mary Ann Formely Mary Ann Dewitt of the County of Hardin and the State of Kentucky of one part and John Dragoo of the Co of Nelson and state aforesaid of the other part witnessth; that the said Peter Dewitt as Heir at Law and the said Mary Ann Middleton as widow of said John Dewitt dec'd , for and in consideration of the sum of $93.75 pd by said John Dragoo to said John Dewitt, in his life time -- granted to said John Dragoo a certain tract or parcel of land lying in County of Nelson & State aforesaid containing 62 1/2 Ac lying on East side of Wilson Creek and Binding on the Salt Creek and being a part of a tract conveyed to John Dewitt by Abijah McGee by deed bearing date 19 Nov 1826 is part of said tract containing 940 acres which lies on the West side of Wilson Creek--- --- signed Peter DeWitt (seal) Elijah Middleton (seal) and Mary Ann T (Thrall) Middleton.

There was land own in Scotts Co IN so will was also recorded there. It is thought that this land could land they were able to acquire because Henry could have received this for being with John Rogers Clark The Archives in IN needs to be checked.

1835 Tax Nel Co: Peter DeWitt, Mary Ann DeWitt (John's widow) 300 acres &Will
WILL: Peter DeWitt of Nelson County --I will & bequeath to my dear wife Olipha Dewitt so much of my land as she wish to obtain her support as long as she remain my widow, also household & Kitchen furniture - also as much stock and farming utensils as long as she remain a widow; Should she intermarry with any other person thus she be governed by what the law allow her provide this will HAD NOT been made and at the death of my wife to be equally divided between my youngest son, John Henry Dewitt and the unborn child which my wife Olipha Dewitt is now pregnant with Should it (baby) live Also all the remainder of my estate both real and personal and mixed of whatever kind it may be I will, bequeath to my son John Henry Dewitt and the child unborn with which my wife is pregnant with, as above stated should the unborn child not live then the above provisions is for the sole benefit of my youngest son John Henry Dewitt.

Probate will: dated 14 Sep 1840 Nelson Co KY.
The will mentions only wife Oliph, son John Henry and "unborn child with which wife is now pregnant. But note that he calls John Henry his "youngest son", indicating that he had older ones.
However there is another document dated 27 July 1862 wherein Olip released her claim to lands in Scott Co to her two sons, John Henry and James Henderson DeWitt. (Will Book A pg 139.) Helen Perry has a note that James Henderson DeWitt is the child Oliph was pregnant with in 1840 (when the will was probated.) He would have been about 22 years old when the later document was filed.

Date 10 Apr 1840, probate 14 Sep 1840. Exec: John Samuels. Witt: P.P. Samuels, James Cheshire. Heirs: wife, Oliph. son, John Henry. Unborn child with which wife is now pregnant (this was James Henderson mentioned hereafter).
On 17 Jul 1862, Oliph released her claim to lands in Scott County, to her two sons, John Henry and James Henderson. Will book A-139.
