I Russell Prouty of the City of Oskaloosa in the County of Mahaska and State of Iowa of the age of years and being of sound mind do make, publish and declare this my last will and Testament in the manner and form following to wit
First I give and bequeath unto my wife Nancy R Prouty all of my interest i the retail Grocery Store of R Prouty & Son in Oskaloosa and all my interest in the accounts due to said firm from any an all persons whomsoever, Also my two gray Ponies and Spring Wagon also Four hundred Sheep more or less being my entire flock of Sheep now kept upon my farm in Keokuk County Iowa, I give and bequeath to the said Nancy R my wife all to the above mentioned property absolutely
I further give and bequeath unto my said Wife Nancy R all of my household furniture & wearing apparel situated in my dwelling house in Oskaloosa Iowa to hold the same for her own during her life, and at her death to be equally divided amongst all of my Children, share and share alike.
I further devise unto my said wife the following described Real-Estate to wit The South East quarter of the North West quarter of Section No. Sixteen (16) in Township No. Seventy Six (76) North of Range No. Thirteen (13) West in Keokuk County Iowa to hold the same in fee simple
I further devise unto my said Wife Nance R the Homestead now used and occupied by me and described as follows to wit Lots No. Seven, Eight, Nine and Ten (7, 8, 9 & 10) in Kinsmans Subdivision in And Lot No. Six (6) in the City of Oskaloosa Mahaska County Iowa (Original Plat) to hold the same during her life for her own use and enjoyment, and from and immediately after her decease I give and devise the said Homestead last herein described unto my daughters Emma Prouty, Adelaide Wilson and Mary E Prouty, equally Share and Share alike in fee simple
Second I give and devise unto my Son Edwin Prouty all of the Real-Estate that I have acquired by descent from my late Son George Prouty said Real-Estate being situated in Noble County State of Ohio to hold the same in fee simple
Third I give and bequeath unto my Daughters Emma Prouty Adelaide WilSon and Mary E Prouty all of the money which I have inherited from my mother's estate yet remaining due & unpaid to me being such part as now remains due and unpaid only
Fourth I give and devise unto my son Cheney Prouty the following described Real-Estate Situated and lying in Keokuk County and State of Iowa to wit
The South West quarter of the North West quarter of Section No. 16 (16) in Township No. Seventy Six (76) North of Range No. Thirteen (13) West to have and to hold the same in fee simple
Fifth I give and devise unto my two Sons Charles Prouty and William Prouty the following described Real Estate to wit, The South East Quarter of Section No. Eight (8) in Township No. Seventy Six (76) North of Range No. Thirteen (13) West in Keokuk County and State of Iowa, also Beginning Five (5) Chains West of the South East Corner of Section No. Thirteen (13) in Township in Township No. Seventy Six (76) North of Range No. Fourteen (14) West, thence West Fifteen (15) Chains and forty (40) links, thence North Ten (10) chains, thence East Fifteen (15) Chains and forty (40) links thence South Ten (10) Chains to the place of beginning in Mahaska County Iowa to hold the same in equal parts, share and share alike in fee simple
The said bequest being however subject to the following conditions - my wife Nancy R Prouty shall have all of the rents and profits of the said farm for the use of herself and family in such manner as she many deem best until my son William shall become Twenty one years of age and that when my son William shall arrive at the age of Twenty one years, then I direct that he and my said son Charles shall each pay unto my said wife Nancy R (if she be then living) the sum of One hundred dollars. and upon the payment of the said fum of one hundred dollars each as aforesaid at the time aforesaid I direct that they my said sons Charles and William shall immediately enter into the full possession and enjoyment of said land. And I further direct that if my said wife Nancy R should die before my son William arrives at the age of Twenty one years then said William and Charles shall immediately enter into the full possession and enjoyment of said Real Estate without the said payment of One hundred dollars each being made as aforesaid
Sixth I direct that all personal property not hereinmentioned included notes, book accounts and other personal property shall be used and applied by my Executor for the payment of my funeral expenses and expenses of my last sickness and other debts that I may owe at the time of my death. And if any such property should remain after the payment of all my debts, I give and bequeath the same to my wife Nancy R Prouty
Seventh I hereby appoint my Son Cheney Prouty the Sole Executrix of this my last Will and Testament
Executed this Tenth day of November A D One Thousand Eight Hundred and Sixty Eight (1868) at Oskaloosa Mahaska County Iowa

The above instrument consisting of Seven pages of legal cap paper in Two sheets was at the date thereof signed and declared by the said Russell Prouty as and for his last Will and Testament, in the presence of us who at his request and in his presence have subscribed our name as witnesses thereunto
