Benjamin Rhodes to Jacob Rhodes
Deed of 400 acres of Lands
This Indenture made this thirteenth day of July in the year of our Lord one thousand
seven hundred and eighty four between Benjamin Rhodes of the County of Duplin and State of North
Carolina of the one part and Jacob Rhodes of the County and State aforesaid of the other part.
Witnesseth that the said Benj. Rhodes for and in consideration of the sum of one hundred pounds
specie to him in hand paid by the said Jacob Rhodes before the sealing and delivery hereof the
receipt whereof he doth hereby acknowledge he the said Benj. Rhodes hath granted bargained & sold
aliened and confirmed and by these presents doth grant, bargain and sell alien and confirm unto
sd. Jacob Rhodes his heirs and assigns forever four hundred acres of land lying and being in the
County aforesaid situate on the North side of Limestone below where the road crosses said Limestone
Swamp. Begining at a water oak and gum near Thankful Hicks' line on the swamp and runs North one
hundred and eighty poles to a Pine; thence East three hundred & sixty poles to a stake; thence
South one hundred and eighty poles to a pine on the Swamp; thence the swamp to the begining. The
above mentioned land was granted to the said Benj. Rhodes by patent and all and singular the rights,
priviliges herititaments & appurntenances to the same or any part thencof in any manner belonging
or assertaining and also all the estate rights, title, interest, claim and demand whatsoever of
him the said Benj. Rhodes of in and to the said premises and every part and parcel thereof. To
have and to hold the said four hundred acres of land and premises above mentioned and every part
and parcel thereof, with the heriditaments and appurtenances thereunto belonging unto the Sd.
Jacob Rhodes his heirs and assigns to the only proper use and behoof of the said Jacob Rhodes
his heirs & assigns forever, and the said Benjamin Rhodes for himself & his heirs the aforesaid
four hundred acres of land & premises and every part and parcel thereof against him and his heirs
and against all and every other person & persons wharsoever to the said Jacob Rhodes his heirs
and assigns shall and will warrant & forever defend by these presents. In whitness whereof, he
the said Benjamin Rhodes has here unto set his hand and affixed his seal the day and year first
above written.

D2-227In the name of God amen. I Benjamin Rhodes of the County of Duplin and State of North Carolina, Being aged and infirm, Calling to mind the mortallity of man do whilst in perfect mind and memory make and declare this my last will and testament in manner and form as follows Viz: First and principally I bequeath my soul to the hand of almighty God who gave it with a retainee my Lord Jesus Christ for Remission of my Sins, and my body I submit to the dust from whence it came to be buryed in a decent and Christian like manner at the descretion of my surviving friends. - Item I leave to my beloved wife Rachel Rhodes our negro woman name Raze our negro boy named Daniel and one negro girl named Charlotte and all my household future not otherwise herein given also my stock of Horses, Hogs, Cattle sheep and poltry likewise my Plantation tools during her natural life and in case necessity should require absolutely for her as her families support to sell any of the above mentioned property I give so much thereof to be sold for that purpose at the descretion of my Executors here after named or herself in case of his Death. Item I leave the use of my Plantation and benefit thereof wheron I now life containing by estimation one Hundred and fifty acres also my negro man Peter and boys George and Frank during her natural life. Item I give and bequeath to my son Joseph T Rhodes my negro boy George after the death of his mother to him his heirs and assigns forever. Item I give and bequeath to my son Jacob Rhodes my negro man Peter after the death of his mother to him his heirs and assigns for ever. Item I give and bequeath to my Daughter Nancy Powell my negro man Mingo, to she her heirs and assigns forever. Item I give and bequeath to my son John F Rhodes the land and Plantation whereon I now live after the decease of his mother containing by estimation one Hundred and fifty acres to him his heirs and assigns for ever. Item I give and bequeath to my grandson John Brock one tract of land lying on the north side of Limestone opposite and above Wallers Mill except a part of that survey sold to Samuel Whaley. (which Survey contains in the whole by estimation one Hundred and fifty acres) to him his heirs and assigns forever. Item I give and bequeath to my grand daughter Elizabeth Miller my negro boy named Frank after the death of my wife to her, her heirs and assigns forever likewise the bed bedstead and furniture wherein I lie Item I give and bequeath my negro girl Charlotte and boy Daniel and all the remaining part of my Estate after the death of my wife Rachel Rhodes to be equally divided by sale or other ways to my sons Joseph L Rhodes and Daughter Rachel Newkirk and Nancy Powell also my grand daughter Mary Brice and ? Jean Brice daughter of my daughter Massey Brice Decd The part I leave to my said grand daughters to be kept in the case of my executors hereafter named until they become of the age of twenty one years or are marryed and in case Either of them die without issue the one the one living or surviving to whereit her share by this my will and in case both die without issue their legacy to revert to my said sons Joseph L Rhodes and Jacob Rhodes and daughter Rachel Newkirk and Nancy Powell. Lastly I constitute and appoint my son Joseph Thomas Rhodes Executor to this my last will and testament in witness whereof I hereinto set my hand and seal the sixteenth day of January in the year of our Lord one Thousand Eight hundred and four
