"I was married in 1869 to Mary Barfield. my wife and I lived on the land with Mrs Nancy Barfield and Ally from the time of our marriage to 1885. All of us then moved off the land to another tract I got from my uncle. we then rented the land out. We all occupied the land together up to Mrs. Barfield's death. After her death I have continued to rent it our for my wife and Ally, when the plaintiff offered to pay us the $350 to Mary & Ally each we notified him that we declined to accept the money and we notified him that Mary & Ally held the land under the deed from their mother. I was agent for my wife & Ally Barfield."

I, Daniel A. Cogdelll, of Mount Olive, in the County of Wayne and State of North Carolina, being of sound mind and memory, but considering the uncertainty of this life, do make, publish and declare this my last will and testament:
Item 1. I give and bequeath to my nephew, D. C. Cogdell, son of Needham C. Cogdell, my gold hunting case watch and chain.
Item 2. I give and bequeath to my brother, Chappell M. Cogdell, two hundred dollars ($200.00) in money.
Item 3. All the rest and residue of my property and estate, real, personal and mixed, I give, devise and bequeath to my brothers John A. Cogdell, and Needham C. Cogdell, absolutely and forever, share and share alike.
Item 4. I nominate and appoint my nephew, D. C. Cogdell, executor of this my last will and testament.
Item 5. I herby revoke and declare utterly void any and every other will and testament made by me heretofore, if any such should be found.
In Witness Whereof, I, Daniel A. Cogdell, have hereto set my hand and seal, this the 22nd day of May, A. D. 1918.
