Hebert, Texas, on 1-28-1862, and served in first Co. H. and then Co. K of the 10th TX Infantry. He was soon promoted to Lieutenant.
In January 1863, he was captured at Post Arkansas near Little Rock. He was exchanged several times and finally held at prisoner of war hospital in Richmond, Virginia, where he died of pneumonia due to tuberculosis. He was buried at the Hollywood Cemetery in Richmond, Virginia.
His letter to son James in September 1862 showed his concern that his sons were not following his wishes for their life style choices, and he begged James to continue his education and not follow the inappropriate guidance of his brother William.
Both sons were soon hanged as horse thieves by a vigilante group near Oglesby, Texas.
