Action by William Niles Wishard, Jr., executor for the last will and testament of William Niles Wishard, dec'd, against the U.S. of America to recover back federal estate taxes paid under protest.
Junior lost his case, but some interesting facts can be derived.
Dr. Wishard died 22 Jan 1941, survived by his widow, two sons, and a sister. The dispute concerned an annuity being paid to the widow and sister - an annuity that had been in effect for several years before his death, so he apparently felt responsible for the care of this sister [probably Elizabeth Moreland Wishard]. The payment of estate tax on this annuity was the bone of contention. It was noted that Dr. Wishard was a specialist who practiced with three other doctors and operated a clinic in Indianapolis. He was a member of the staff of City Hospital in Indianapolis and on the staff of the medical school at City Hospital. He was a member of the Advisory Council of the Methodist Hospital and chairman of the committee on professional standards. From 1932 to 1940 he attended meetings of the State Medical Assn. being chairman of its bureau of publicity. He delivered several addresses from 1933 to 1938, dictating them to his secretary but then committing them to memory and delivering without notes. He traveled often; made a trip to New York in 1937 and one to the West Coast with his wife. He was remarkably active and alert both mentally and physically for a man of his years. Wishard's will was executed Sept 1940. The family history was one of long life as his father was a physician in active practice until his ninety-fourth year. The decedent died after an illness of six days from a coronary occlusion resulting in cardiac failure followed by terminal pneumonia.

William was buried 25 Jan 1941, Crown Hill Cemetery, Indianapolis.
