Cornelia E. Avrett died intestate leaving twelve children as heirs at law. All are living, none are minors. She died possessed of a tract of land, 48 acres, described in a deed from C. L. Daniel and wife to Cornelia E. Avrett, Deed Book 275, p.213.
Petition for Sale, Filed 2 Feb 1934: R. A. Avrett and wife Bessie A. and L. T. Avrett, vs. W. G. Avrett and wife, Sallie D. The nine heirs not listed have conveyed all their interest in said lands to W. G. Avrett & wife, Sallie D. Avrett, 27 Jan 1934, not yet registered. They are all now tenants in common - W. G. Avrett, R. A. Avrett & L. T. Avrett each entitled to one twelfth of said tract - W. G. & SAllie also entitled to the interest of the other nine heirs. One of the heirs, Earl Avrett, is indebted to the estate in the sum of $157 plus interest; his share of the personl property will pay about $60 leaving a balance due the estate. Actual partition of the lands cannot be made, but a sale would best conserve the interests of all the tenants.
14 Mar 1934. Petition granted for sale of tract.
17 Apr 1934. The Commissioners, Clem B. Holding & N. Y. Gulley, reported the sale for cash, at the Courthouse door, Wake Co, on 16th April after due advertisment. W. G. Avrett became the highest bidder at the price of $1800. The Commissioners are to pay out of the purchase price, all costs of sale and their fee ($120). The remainder shall be paid, 5/6 to W. G. Avrett & Sallie D. Avrett; 1/12 to L. T. Avrett, and 1/12 to R. A. Avrett.
23 May 1934. Final report - Purchase price $1800. Disbursements to auctioneer, advertisement, court costs, commissions - $114.00. $140.50 pd R. A. Averett. $140.50 pd L. T. Averett. $1405.00 pd to W. G. Averett - Total $1686.00
