Civil War - Mustered in Nov 26 1861 Co. H, 9th Kentucky Infantry; transferred to Co. G, 23rd Kentucky Infantry in November 1864. Mustered out in Nashville, TN June 17, 1865.

"Isham Tooley - War Service Record
Arthur Tooley had six sons. Five of them, Isham, William, John, Joshua and Theodric answered the call to duty at the onset of the Civil War. They all served in Company H, 9th Kentucky Infantry.
After becoming ill shortly after mustering with Co. H. 9th Kentucky Infantry he was detailed as a Nurse in the camp hospital for a period of 40 days.
Nothing much is recorded until December 31, 1862 at the Battle of Stones River where he was both reported as 'Prisoner of War' and as 'Deserted during the battle'. He had in fact returned to Monroe County and did not rejoin the regiment until August 10, 1863.
He was tried at a General Courts Martial on December 18, 1863 and was found guilty of desertion. His penalty was "to forfeit all pay and allowances for seven months". While Co. H mustered out of the army on December 24, 1864, Isham was transferred to Co. G of the 23rd Kentucky Infantry on November 24, 1864 by general order to "make good his time for desertion to wit from Dec. 31, 1862 to Aug. 16, 1863.
He was finally discharged at Camp Harper in Nashville, Tennessee on June 17, 1865.
Having completed his sentence and 3 year term of enlistment the War Dept. stated that the 'charge of desertion no longer stands against him' but were unwilling to expunge his records."
Brothers John and Joshua died in service, 1862, a few months apart, as did several Tooley cousins.
