Henry Garner

A Henry Garner whose wife was Nancy. was born in Rowan Co, North Carolina, did live for a time in Kentucky, but a court case in 1851 concerning the sale of his land for the benefit of his nine heirs, proves that he had a very different family, see later. However, a power of attorney in his Pension file, R3919, from Hardin Co TN, says that his wife was Nancy who died in 1819. Henry himself lived until 1835. This man has often been conflabulated with this Henry whose wife was Nancy Poole. The Rev War Henry had a very different set of children in Hardin Co TN, and appears to have married a second time to an Elizabeth.

Henry Garner departed this life the ___ of ___ 1848, possessed of considerable real estate consisting of 3 tractsof land:
One in Pickens Dist on waters of Eighteen Mile creek, containing 100 acres, the balance of a tract purchased from Robert Anderson Jr. containing 275 acres, 175 being conveyed in the lifetime of Henry Garner.
Another tract lying in north branches of Eighteen Mile Creek, part of tract purchased by Henry Garner from Robert Baker originally containing 96 acres, of which tract Henry Garner conveyed 15 acres, leaving 91 acres.
Another tract purchased from Thomas Garvin containing 130 acres lying in the west side of little Eighteen Mile Creek of which Henry Garner conveyed 25 acres, leaving 106 acres.
The lands are subject to distribution among the widow, Nancy Garner, and six children: Polly Boggs, formerly Polly Garner, widow of Thos. Boogs, deceased; Mahala Fennel, formerly Mahala Garner, wife Hardy Fennel, Ruhama Neighbors, formerly Ruhama Garner, widow of Barnett Neighbors, Matilda Garner who married John Garner, the legal heirs of Sylania Boggs, formerly Sylvania Garner who married Aaron Boggs and departed this life in the year 18__, leaving the following legal heirs - Josiah N. Bogg, James A. Boggs, Matilda Garner, formerly Matilda Boggs, wife of William Garner, who resides without this state, Henry G. Boggs, Monroe Boggs who resides without this state, Elizabeth Mullenay, formerly Elizabeth Boggs with of John Mullenay who resides without this state, Madison Boggs, a minor over the age of 14 and about age 20 and Martha Boggs, a minor over the age of 12, the said minors are unrepresented by guardians; and your orator James Garner.
This shares may not be possible to distribute otherwise than by sales. Request guardians be appointed for minors, Madison Boggs and Martha Boggs. Request subpoenas to all parties to appear and answer.

Feb 1849. Aaron Boggs appointed guardian of Madison & Martha Boggs.

7 May 1849 Commissioners were ordered to divide the lands in such a manner to allot Nancy Garner, the widow, one third part. The remaining two-thirds, divided among six children, the heirs of the dec'd: Polly Boggs; Hardy Fennel & wife Mahala, Ruhama Neighbors, John Garner & wife Matilda, James Garner, the heirs of Sylvania Boggs, dec'd.
If the land cannot be divided without injury to some of the parties, then the value is to be appraised.
3 Sep 1849. The land was sold.
1. to aaron Boggs Jr. for $676.00
2. S. A. Boggs for $310.00
3. Hardy Fennel for $312.00
Bonds were taken for payment in installments, one and two years after the date of sale.

2 Sep 1850. Mary Boggs requested her share of her father, Henry Garner be paid to Aaron Boggs.
9 Sep 1850. Hardy Fennel and Mahala Fennel received $213.73 in full for the distributive share of the Real Estate of Henry Garner
Sep 1850. Ruhama (X) Nabors signed that she did not claim any part of the estate of her father, Henry Garner, dec'd. To be regarded as her acquittance.
Sep 1850. James Garner also refeused to claim any part.
9 Sep 1850 John (X) Garner and Matilda Garner received $213.73 share of Henry Garner's real estate.
9 Sep 1850. A. G. Boggs, son of Sylania Boggs, dec'd rec'd $26.70 as his distributive share.
9 Sep 1850. Josiah Boggs, son of Sylania Boggs rec'd $26.70.
9 Sep 1850. J. A. boggs received $26.70

27 Dec 1850. Nancy and William B. Garner received her share [not stated but as Nancy Boggs she was due $26.70]
17 Dec 1850. William A. Mullinex and Sylvania (Boggs) his wife appointed Aaron Boggs, power of attorney, to receive their share.
11 Jan 1851, Aaron Boggs received $26.70 plus interest of $1.74,, the share of John and Elizabeth (Boggs) Mullinex by Power of Attorney.
1 Apr 1852. Aaron Boggs received $26.70, the share of his ward, Martha Boggs.

13 April 1852. John T. Sloan, Executor of the Nancy Garner, dec'd signed a receipt for $150.17, the balance of her share of the real estate of Henry Garner.

Info: This is primary a family cemetery, with a few graves of other people from the community buried there. The remains of an iron fence remain near the front on the ground. About 20 + graves are marked with only rocks no info. Not maintained but will be.

Died, at his residence in Pickens District on the 23d of November 1848, Mr. HENRY GARNER, in the 74th year of his age. He was born in Randolph County North Carolina; he commenced life with a mere pittance, but by industry and economy he made a handsome living; he, preparatory to his future happiness, joined the Baptist Church some 10 years since, and lived and died in full fellowship with the society. He had left many friends and relatives to mourn his irreparable loss, but the consolation in "Blessed are they that die in the Lord, for theirs is the Kingdom of Heaven"
