Laban Walters

There are estate papers in Williamson Co TN for Laban Walters Jr. dated 1878 - a record of inventory and settlement. There are files for Laban Sr. and for Lindsey L. [Laban] Walters which can be accounted for as this man's grandfather and uncle, respectively. The heirs listed were his mother, brother and sister so he never married nor had issue.

Laban was alive in 1874, when there was a lawsuit regarding the estate of his father, Edward Walters.

On 30 Mar 1878, J. R. Carothers, Admr of Laban Walters, filed his report of the Inventory. It was confirmed at the April term of court. The report is dated 22 Mar 1878.
The following notes were listed:
L. H. Holt, Thos. Holt & Frank Wilson. $1000.00. Collection doubtful.
W. N. Cox payable to S. E. Walters, due 1 Jan 1877 - assigned by S. E. Walters to Laban Walters on 17 May 1875. Part paid.
James G. Crockett for $50.
Bill on J. E. Walters 1 Jan 1877 for $20.00
Listed after the bill, but said to be notes:
James Mahan due 1 Jun 1877 for $100.00
Note on John P. Owen, dated 15 Oct 1874, payable 1 Jan 1876 to Jas. H. Wilson for $450 and assigned by Wilson to N. N. Cox and by W. M. Cox assigned to Laban Walters, on 23 Dec 1875. Some paid by N. N. Cox. Disputed.
Note on J. E. Walters, Mary E. Walters, and W. C. Walters, $119.00. Good.
Claim on some parties in West Tennessee for an interest in a mule for which $23 was realized. 1878.
Horse saddle & bridle sold to Jo Walters, 18 Mar 1878, for $60.

Settlement filed 14 Nov 1878; Recorded April Term, 1879.
Carothers had received the payments on the notes - a total of $1465.75.
Expenses for the estate including a payment for $203 to a doctor and $80 for burial case and expenses for collecting money from West Tennessee, and other amounts, left $911.07 in the estate.

On the 14th of Nov 1878, with Mrs. Pattie Carothers, Executor of James R. Carothers, dec'd, the settlement was examined. $146.71 was still due the estate of Laban Walters, dec'd. E. J. Walters qualified as administrator de bonis non on the estate of Laban Walters and Mrs. Carothers executed a note to him for the balance. All parties were of age and present. Signed: Thos. F. Summons issued to Mrs. J. R. Carothers (admx) of James R. Carothers, admr of Laban Walters (Dec'd), to appear in court in Franklin on 14 August to render account of the estate of Laban Walters. Signed 8 Aug 1882. There is nothing in the file to indicate any more information about this Summons.

There is a paper in the file of Laban Walters Jr. that should have been filed with Laban Walters Sr. It says "Laban Walters, Inventory, 1854". Lists only three items - one old still, a pair of card, one spining wheel. Signed Edward Watters, who was admin of the older Laban's estate.
