p.414 18 Oct 1790 Jane Payne Widow & Relict of John Payne, Gent. Dec'd. James Gordon & Ann his wife. Philip Payne. William Lee and Jane his wife. Smith Payne. George Woodson Payne, Robert Payne. Only children now living. To Mildred Matthew Payne another of the children….can't read bottom line [apparently Mildred died]. An infant under the age of 21 unmarried and leaving no issue so not being made a party. Chilcot Symes of Poorstock in Dorset Co, England by his his last will & Testament 24 Jun 1752, gave all the rest and residue to his nephew Richard Chichester of Lancaster Co VA, Esq. and appointed sd Richard Chichester his Executor. Richard Chichester by his last will, 16 May 1743, gave to his son John Chichester all his estates in England both real and personal. John should have all delivered to him at age 20 years. Wife Ellen Chichester, executrix & son John, executor. Richard died 25 Dec 1743. Ellen the widow declined to prove said will and John was then an infant. Administration was granted by Prerogative Court of Canterbury to John Tucker & Richard Tucker of Weymouth in County Dorset for the benefit of John Chichester during his minority. On 22 Jul 1752, John Chichester intermarried with Jane Payne, then Jane Smith Spinster. By his last Will, 24 Sep 1753, John Chichester gave to his wife Jane 500#'s Sterling and directed his legacies to be paid out of his English estate and thereby gave to his Brother Richard Chichester all his estate both real & personal in England after the Legacies were paid. Whereas John Chichester died 14 Jan 1754, before he attained the age of 21. No part of his real Estate could pass . Jane, the widow of John Chichester on 23 Jun 1757 intermarried with John Payne, dec'd. Decree of the High court of Chancery in England, 23 Mar 1765 made cause wherein Richard Chichester the second son of said Richard Chichester the testator was plaintiff and the said John & Richard Ruck, the said John Payne, called John Payne the Elder and Jane his wife, and others were defendants. Among the things ordered to take account of the personal estates of said Chilcot Symes & Richard Chichester. It was declared that the clear residue of the personal estate of Richard Chichester belonged to said John and would constitute part of his personal estate and ought to be applied as such. …surplus of the said John Chichester after payment of debts, funeral & legacies then that the said Richard Chichester should be a Libetry to to apply to the Court concerning same. As to such Estate of Inheritance as the said Richard Chichester died seized of it was declared that Ellin his widow become entitled to one third part for her dower. Rents and profits during the life of said Ellen, one third. One third of the two thirds was deemend to belong to said Jane, widow said John Chicester in right of her dower and should be paid to the said John Payne in right of his wife Jane. Also to take account of the rents & profits accrued since the death of said Ellen his widow, and that one third part therof belonged to the said Jane Payne, widow of John Chichester as her dower and should be paid her. John Payne departed this life 29 Jun 1784 having first made his Will proved in Goochland and did give and devise to his wife Janye Payne, all the estate of all kind whatsoever which he had by her or could have any right or title to by his marriage with her to dispose of as she shall think proper among and for the benefit of all her children by him except part of the furniture of her house which was mostly sold of.. Jane Payne in consideration of natural love and affection for her children: Ann Gordon, Philip Payne, Jane Lee, Smith Payne, George Woodson Payne & Robert Payne. James Gordon & Ann, two full sixths parts. Phillip, one full sixth part. William Lee & Jane, one full sixth part. Smith Payne one full and sixth part. George Woodson Payne one full and entire sixth part. To Robert Payne 20sh deducted out of one of the two parts give to James Gordon & wife Ann. Robert being an infant under age 21.
