Colonial Wills of Henrico Co VA, Part 2, p.15: Will of Cuthbert Williamson presented Sept. Court 1743. John Williamson & Elizabeth Williamson were appointed exec. of Cuthbert Williamson dec'd whose will is not signed. John Maddox he was asked by Cuthbert to get John Price to write the will. When Price came he was afraid to go into the room because Cuthbert was sick with the flux. Will was written on directions and later read to him by John Williamson. John Price deposed that he wrote the will on instructions given by John Maddox. Will admitted to probate. Elizabeth, relict and widow, relinquished all benefit. Appraisors: Henry Stokes, John Watson, Matthew Hobson & John Mosby. [Apr Court 1743]

Lay of to Elizabeth Allen the third part of the Estate of Cutbirt Williamson deceased that is to say four Negroes, to wit Sam, Bob, Temp and Jane, Seven head of Cattle, three horses and Twenty pounds Cash and part of the household Goods, Also did divide the other part of the Estate between three Orphans as follows. To Susanna Williamson, three Negroes, Joe, Lucy and Patt, to Mary Price, Jack Sarah and Chloe, To Cutbirt Williamson Two Negroes Moll and Mitilla, these two Negroes Equal worth the others (who had each of them one more) and Added fifteen pounds Left unprovided for the use of the Orphans, thirteen head of Cattle four houses, three Mares and a parcell of household goods. Charlotte Co DB p.82 3 Oct 1768. Samuel Allen & Elizabeth his wife of Charlotte Co to William Smith of Cumberland. 295 A on Cub Creek where they now live. From two tracts: 1st from James Spradling recorded in Lunenburg, 2nd from John Weatherford.
CHARLOTTE CO WB 1 p.386. Elizabeth Allen [Death Bed; Oral Will] 20 Apr 1786 and proved 2 Oct 1786. "We being present at the house of Cutbirth Williamson on 20 Apr 1786 heard Elizabeth Allen on her Death Bed say: Cutbirth I want what little I have divided between you three, then being asked whether she meant Cutbirth Williamson, Mary Price & Susannah Williamson [she answered yes] saying There was some money due to her. Wit: Martha Madison, Mary Pettus.

This Noncupative Will of Elizabeth Allen deceased was proved in open Court by Martha Madison and Mary Pettus, the two witnesses that were present at the speaking the Testamentary words and by them committed to writing as above which is ordered to be Recorded.
Apparently there were children of the marriage to Samuel Allen that believed they were cut off from their rightful inheritance because of the above nuncupative will made by Elizabeth when she only recognized the children of her first marriage. It also appears Elizabeth and Samuel had ceased to live together at some point. The following found in Charlotte Co VA Chancery Court Files 1765-1912; Virginia Memory, Library of Virginia website.
To the Worshipful Court of Charlotte County Setting in Chancery:
8 April 1788
Humbly complaining, shoeweth unto you Worships that your Orater Cain Jackson some time in or about the year of our Lord Christ one thousand, seven hundred and seventy _____ intermarried with a certain Drucilla Allen, Daughter of Samuel Allen & Elizabeth his wife. That the said Elizabeth before she intermarried wit the said SAmuel Allen, was the widow of a certain ______Williamson, having had sundry children by that marriage also one of whom was Cuthbert Williamson who your Orator prays may be made a defendant hereto. That some years before the death of the said Samuel Allen & Elizabeth his wife, the said Samuel took up his residence in Henrico County and the said Elizabeth in the County of Charlotte, each of them possessing some small property. That the said Samuel departed this life some time in or about _____ without having made any disposition of his property as your Orator has been informed, that in a short time afterwards the said Elizabeth his wife departed this life without having ever administrated on her said Dec'd Husband's estate, but she devised the same away a nuncupative will as it is pretended by the defendant hereto, leaving the same to the children by her first marriage, altho it was the proper estate of her last Husband by the law of the land & unadministered in her hands, that under the pretended devise so as aforesaid made, the defendant undertook to dispose of and sell all the estate found in the possession of the said Elizabeth Allen at her decease. That your Orator conceiving himself entitled to a third part of the Estate of Samuel Allen because there were but three Children by the said marriage, to wit, Sherwood Allen, Elizabeth who intermarried with a certain Barksdale & Drucilla, your Orator's wife. attended a sale made by the defendant of the goods & Chattles found in Possession of the said Elizabeth at her decease. That your Orator became the purchaser to the amount of fourteen pounds, eight shilling and five pence for which he accounted his bond to the defendant as administrator of the said Elizabeth Allen. That since that time the defendant has prosecuted a suit at common law against your Orator upon the said bond and hat obtained Judgment and threatens further prosecution, although your Orator has always been reddy and willing to come to a fair settlement, paying any ballance that may be due after deducting, the distribution that your Orator is entitled to of the estate of the said Samuel Allen which remained unadministrated in the hands of the said Elizabeth at the time of her Death. All which actings and doings of the said defendant, are contrary to equity and good conscience and tend manifestly to injure and oppress your Orator intent or consideration whereof and for as much as your Orator is
