Know all men by these presents that I Henry Van Hyning of the township of Norton in the county of Medina, and State of Ohio being advanced in years but of sound disposing mind and memory and understanding and considering the certainty of death and the uncertainty of time and being desirous of setting of my worldly affairs whilst have strength and capacity so to do, and to the end I may be the better prepared to leave this world whenever it shall please God to call me hence, do make declare this my last will and testament hereby revoking and making void all former wills by me at any time hence fore make. And first that all my debts and funeral expenses by paid as soon after my decease as conveniently may be out of my personal property. Second I give devise and bequeath all my messenger lands ..., situate l;ying and being in the township of Norton, Medina ounty and state of Ohio including the farm which I now live on together with all other real property wich I bow or may at my decease possess to my youngest son, Sylvester Van Hyning who now lives with me, Provided that my son Sylvester shall after my decease, pay to my other sons hereafter named, the sums specified to paid to each of them at the time herein after mentioned to wit that he pay to my son Isaac Van Hyning if he is living at my decease fifty dollars and unto my son Jacob Van Hyning one hundred and fifty dollars if living at my decease and also that he pay unto my son Thomas Van Hyning one hundred dollars and also that he pay unto my son Henry Van Hyning one hundred dollars if living at the time of my decease and that he pay unto my son Andrew Van Hyning one hundred dollars if living at the time of my decease to b paid as follows to wit one fourth of the amount going to each to be paid in one year from the time of my decease and one fourth in two years after the time of my decease one fourth in the three years after my decease and the remaining fourth to be paid in four years after my decease and now in case either of my sons shall die before I decease it may will that his legacy shell be equally divided between my sons and daughters living at the time of my decease. I do further will device and bequeath unto my three daughters, Thamor Clark, Hannah Baker wife of Samuel Baker and Sally Lions wife of Charles Lions if living at the time of my decease all my personal property aftr paying my debts and funeral expenses to be equally divided between them and in case either of my said daughters shall decease before I depart this life then her portion to be equally divided between my sons and daughters living at the time of my decease ... I do further declare it be my situation that the children of my son Abram Van Hyning deceased and Lea Robinson children she having deceased that the said Lea and Elizabeth being my daughters that they ... of my sons and daughters deceased shall not take anything by this my will of property either real or personal for it is my express intention that my estate both real and personal shall go to my sons and daughters living at the time of my decease as above devised and bequeath ...2 July 1840
