Samuel Smith

Samuel Smith took the oath of fidelity at Eatham 25 October 1667. He sued Stephen Merrick for unlawfully taking a horse on 25 Octover 1668. The next year he appeared in Plymouth Colony Court to answer suits brought against him by Ralph Smith, Daniel Smith, and Josias Cooke. Samuel served as constable of Eastham in 1670 and the next year was sued by Joseph Harding for abuse of his duties in that position. On 7 July 1682 Thomas Clarke Sr. of Plymouth sued Samuel Smith of Eastham for unjustly detaining profits of a Cape Cod fishing venture. On the first Tuesday in October 1686 Samuel Smith and John Mayo of Eastham were charged with netting mackerel at Cape Cod in violation of a court order.
Grace Smith, relict, and Samuell Smith, son, were named administrators of the estate of Ralph Smith of Eastham, deceased, on 27 October 1685.
Administration of the estate of Samuel Smith of Eastham was granted to Mary Smith, widow, and John Smith, son, 20 April 1697. Heirs mentioned in the order of settlement, made 22 April 1697, were grandsons Samuel and Joseph Smith, sons of eldest son Samuel; son John Smith, and daughter Mary Hamilton. The same heirs were mentioned in the division of the estate of Mrs. Mary Smith of Eastham on 18 July 1700, the administrator being son-in-law Daniel Hamilton.
