Your Petitioner begs to State that Thesame is part of Land formerly applied for by Reuben BrockwayPetitioner Grand Father who has relinquished his right and interestto said Land Excepting The Two Hundred acres awarded by Government toThomas Cloney. Therefore your Petitioner humbly prays that he maybe allowed to purchase the same at Two Shillings and sixpence peracre and if so allowed he is prepared to and will settle himselfupon, and improve the same forthwith and conforn in all respects withthe regulations for granting of Land

This land is part of a Tract of 330acres which were sold to Reuben Brockway in . Mr. Brockway paid to account of the purchase & sold his right on account thereof& 200 acres to Thomas Cloney who has been allowed to purchase thesaid 200 acres on payment of the balance due on 200 acres over &above the amount formerly paid by Brockway. The land herein appliedfor is vacant therefore & contains no meadow, mill site,Intervale, nor Pine timber. It was also applied for on the same dayby Michael Cloney. See his Petition accompanying.

To His Excellency Major General Sir John Harvey K. C. B. and K. C. H., Lieutenant Governor and Commander in Chief of the Province of New Brunswick, &c. &c. &c.The Petition of Michael Cloney of the Parish of in the County of York
Humbly sheweth,
That he is a British subject, born in Ireland and does not own any land; that he wishes to obtain by purchases a tract of Land for immediate settlement, containing one Hundred and Thirty acres, and situate as follows:===
North of Thomas Cloney on the west side of the Magaguadavic River being the vacant part of Land formerly applied for by Reuben Brockway.
The said land is at present in a wilderness state, no improvements having been made thereon. And he requests that he may be allowed to purchase it at Two Shillings and sixpence per acre, payable and if so allowed, he is prepared to, and will settle himself upon, and improve the same forthwith, and conform in all respects with the regulations for granting of land
And as in duty bound will ever pray.

I hereby certify To all to whom it may conce[rn] That several Years ago – I cleared about two acres of land on a lot below upper Trout Brook, so called, near Brockways, bounding South by land occupied by Thomas Cloney's North by a lot owned by Philo Seelye and [ ] the walls of a house thereon and that I subsequently sold the said improvements with my claims thereto to Michael Cloney.

The Petition of Michael Cloney, of the Magaguadavick in the County of York,
Humbly Shewith
That he is a British Subject born in Ireland and does not own any land, and wishes to purchase a tract of land for immediate settlement and Cultivation containing one hundred and thirty acres which he has formerly applied for situate a little below upper Trout Brook a Branch of the Magaguadavick River and bounded South by lands owned by his Brother Thomas Cloney. Petitioner begs leave to State that the lot in question was formerly occupied and improved upon by one Richard Miller whose improvements Petitioner purchased as will appear by the annexed certificate, and Petitioner has Since further improved upon said lot, and has held the uninterrupted possession of the Same Since his purchase, and in order that he Should not be considered a trespasser upon Crown Lands he applied for the purchaseof the land in question as will also appear by the Receiver Generals receipt herewith annexed. - Petitioner begs leave respectfully to to State that a Mr. Michael [ ] a Mr. William Gill and one [ ] Since made application for the same lot, but those persons cannot with any Shadow of Justice Set forth any claim thereto, except that a School House has been built upon the lot, to the erection of which Petitioner contributed more than an ordinary Share of labour in conjunction with his neighbours to which none of the above parties have in any shape either aided or contributed, and Petitioner therefore humbly prays that he may be allowed to purchase the land now applied for, and if so allowed to purchase he pledges himself to give a deed of one acre of land upon which the School House is built to the Trustees of Schools or to such other Person or Persons as may be deemed proper, Petitioner being a married man is desirous of having a good school established in the neighbourhood, there being sufficient land (without interfering with the school lot left) for cultivation, and he therefore prays that the lot in question may not be offered at public sale on the 5th July next, as is proposed, or that the purchaser may be bound to pay for his improvements, and provision made for the School House, herein before mentioned.

This land was applied for on the 1st April last by the Petitioner & one William Gill. And the land was ordered In Council to be sold at Public Auction & now advertised for the 5th of July next. The clearing which is very trifling indeed, is claimed equally by both as Gill has a quit claim from a person named Brockway. Their claims on this account do not seem sufficient to affect the Sale as now advertised, but it may be advisable that one acre may be received for the School House as within suggested.
