In a Cause depending Between John Allen as Admr to the goods Chattles & Creditts of Nicholas Solby plaintiffe, & Stephen GoughDefendant, Mr Gough being not present himselfe, it ordered tht the action be referred till the next Court.Mr Allen being sick it is ordered tht all his other actions be referred till the next Court.(Charles County Court Proceedings, Archives of MD, Vol. 60, p. 581).In a Cause depending betweene John Allen Admr of the goods Chattles & Creditts of Nich Solby dec plaintife & stephen GoughDefendant, Stephen Gough was Attached to Answer to John Allen Admr of the goods Chattles & Creddits of Nich Solby late of this County dec of a plea of trespas on the Case. And whereupon the sd John by Samuell Cressey his Atturney Complaineth against the sd Stephen for tht whereas the sd Nich did on the 13th day of July 1673 & from tht time untill the 16th day of the same moneth attend on him the sd Stephen & administer to him the sd Stephen divers parcells of Phisicke in all amounteinge to the suffie of three hundred & seaventy pounds of tobaccoe, As by a particular account here in Court by the sd John produced more plainly may appeare, In Consideracon whereof the sd Stephen did then assume on himselfe & to the sd Nich did faithfully promise that hee the sd Stephen when thereunto required to him the sd Nich the sd sume of 370th of tobaccoe would well & truely pay, Yett neverthelesse the sd Stephen although often thereunto required the sd suffle of three hundred & seaventy pounds of tobaccoe neither to the Nich in his life time nor to the sd John to whom Administracon of all & singular the goods Chattles & Creditts of the sd Nich was Comitted since his death hath not paid but doth altogether refuse to pay the same, whereupon the sd John saith hee hath lost to the value of 500 lb of tobaccoe & thereupon hee bringeth his suite. And the sd Stephen Gough Defendant (by John Jones his Atturney) comes & defends the force & injury &c And saith hee hath not received the Phisicke within mentioned in maƱer & forme as within exprest &c: nor did not Assume The plaintife wanting proofe to his declaracon, Thereupon the worshipfull the Comissioners orders a nonsuite against the plaintife with Cost of suite. 19 Oct 1677: Stephen Gough made oath that his wife Mary, the admx. of Lt. Col. John Jarboe was not able to travel so far as St. Maries with great danger having been long sick and therefore prays time til the first Tuesday in November next to give her acct. of her admin.(Donnelly).(I have not seen this record to which she refers).
