Deed of Gift, recorded at the request of Raphael Boarman Jr.Whereas Roger Smith of CC, now decd, by his will, bequeathed to his widow, Heneretta Smith, now the wife of Ignatius Wheeler, during her natural life, 12 Negro slaves, to wit, Roger and his wife Peg, and 7 of their children, Bill, Rachel, Ned, Jack, Lucy, Ralph, and Basil, and also Jane, with her 2 youngest children, Hannah and Harry, and after her death to his brother, Basil Smith (also now decd) and also all the increase from the date of his will except a Negro child Jane, the daughter of Raphael, which sd 12 slaves and their increase, excepting as afd, the sd Basil Smith, in his lifetime, by his will, bequeathed to be equally divided between Ann Smith, his wife (party to these presents) and his 2 children, Henry Smith and Dorothy Smith, and sometime after the death of sd Basil Smith, it was agreed between me, sd Ann Smith, Dorothy Smith, now Dorothy Boarman, the wife of Raphael Boarman of CC, and the sd Henry Smith, that sd Ann and Dorothy Smith should convey their shares of sd slaves to sd Henry Smith. It was further agreed between the parties that sd Henry Smith, in consideration thereof, should give up all claim to the slaves, cattle, goods and furniture, and all the other effects and estate of the sd Ann Smith, and that the sd Ann Smith should convey the same to the sd Dorothy Smith now Dorothy Boarman. And whereas sd Ann Smith and Dorothy Smith, pursuant to the sd CC agreement dated last Aug 22, did convey to sd Henry Smith, all their respective rights to the 12 slaves and increase excepting as afd, and sd Ann being willing to convey her slaves and estate afd to sd Dorothy Boarman, now know that I, sd Ann Smith, for the foregoing consideration and for the love I have for sd Dorothy Boarman, my daughter, and for 5 shillings and in further consideration that the sd Raphael Boarman is to support and maintain me, the sd Ann Smith, in a genteel manner during my life, or allow me the net proceeds of my estate (hereafter given) annually, during my natural life, I say that I, for these considerations, have sold to the sd Dorothy Boarman, the following slaves and their increase, viz, Abraham alias Abe, Isaac, Edward alias Ned, Peter, Cate, Victoria alias Vickey, Elizabeth alias Bet, Ann alias Anna, Henry alias Harry, and also the following animals and their increase: 2 large bay mares, one commonly called the backwocds mare, the other, Manille, 1 bay horse bawl, 1 sorrel colt, 1 bay colt, 2 gray colts, 37 cattle of which 10 are steers, 14 cows and 1 calf, 75 sheep "of which 10 are weathers" 2 rams, 40 ewes, 23 lambs, 53 hogs, and also the following furniture: 4 beds with their furniture, 1 large looking glass with a gilt mahogany frame, 1 large mahogany table, 1 table of walnut, 6 silver tablespoons, 6 silver teaspoons, and all debts due me, all my China, my hoes, axes, ploughs, plantation utensils, and all other of my goods, chattels, and estate. Charles County Land Records 1786-1790; Liber D#4; Page 17. Bond of conveyance, recorded at the request of John Boarman. I, Raphael Boarman Jr of CC, am bound to Richard Bennett Boarman of CC in the just sum of 1000 £ sterling to be paid, which money truly to be paid, I bind myself this Mar 31, 1777, to warrant the sd Raphael Boarman conveys, when in his pewer, to Richard Bennett Boarman, all that part of a tract of land called Boarmans Help which lies on the left and south side of the west and by south line, in being the 4th course of a tract of land called Boarmans intention, which west and by south line of sd tract of land is to be continued until it intersects the given line of a tract of land called the Bite, and likewise, shall convey, when in his pewer, to the afd Richard Bennett Boarman, the one half of that tract of land called Boarmans Enlargement, it being a resurvey on that tract of land called Boarmans Help.Signed - Raphel Boarman Jr. Wit - Raphael Boarman Sr,

The deposition of Mary Ann Boarman of CC, relict of Richard Bennett Boarman, decd, says that a parcel of vacant land, which she heretofore took up and had patented to her, by the name of Boarmans Help, was always thought to he part of her decd husband's dwelling plantation, and which was willed by him to her son, Richard Bennett Boarman, and that therefore this deponent, after she had obtained a patent for the sd vacant land, thought she was in duty bound to make over the same to her son, Richard Bennett Boarman, as it had always been deemed to belong to the dwelling plantation called Boarmans Rest, and which was supposed to extend as far as the main swamp or into it. And the deponent being asked by Raphael Boarman, her son, 1st, whether his father, Richard Bennett Boarman, at the time of his death, was not possessed of 2 tracts of land, one called the Bite, the other, Boarmans Intention, which 2 tracts of land are now the right of the sd Raphael Boarman, she answers yes. 2nd, whether these 2 tracts of land were not deemed part of his father's dwelling plantation at the time of his death, answered she does not know. 3rd, did he, sd Richard Bennet Boorman, before and at the time of his death, make use of the above 2 tracts of land as his property, answers yes. 4th, asked by John H, Boarman, had not his decd father, at the time of his death, other tracts of land some miles off from the dwelling plantation, which he made use of as his property, answered yes. 5th, asked by Raphael Boarman whether his father, at the time of his making his will, or at his death, knew of the land now called Boarmans Help being vacant, answers she verily believes he did not. 6th, asked by same whether she held the land called Boarmans Help and possessed it as her property until she deeded the same to her son, Richard Bennett Boatman, answered she did. 7th, asked by John H. Boarman whether she did not always before she had deeded it, allow her son, Richard Bennett Boorman to make use of the land called Boarmans Help as he pleased, answered she did. 8th, asked by Raphael Boarman whether or not her son, Richard Bennett, did not promise her that in case he married, he would give her his bond that she have the use of Boarmans Help, during her life, in consequence of her giving him a deed for it, answered that he did promise it in case it should be required 9th, whether she did not always think that Boarmans Help lay between the Bite, Boarmans Intention, and the lands of her son, Richard Bennett, answered she did. 10th, asked by John H. Boarman whether his father had the land called Boarmans Help in his possession before he was possessed called the Bite, answered yes. llth, asked by Raphael Boarman whether his fattier was not possessed of Boarmans Intention ever since she knew him possessed with land, answered yes. 12th, asked by John H. Boarman whether his father was possessed of Boarmans Rest and Boarmans Low Grounds ever since she knew him possessed of land, answered yes. 13th, asked by Raphael Boarman whether she understood that her son[s], Richard Bennett and Raphael made the resurvey on Boarmans Help at their own cost, and that she was content they should do it, answered that she never made any objection to the resurvey, and that she supposed her above 2 sons paid the expense between them. 14th, asked by John H. Boarman, whether his brother, Richard Bennett Boarman, after he had taken up the land called Boarmans Enlargement, being a resurvey on Boarmans Help did not tell her that the right of the sd land lay in her, answered she thinks he did, as he requested her to make over the half of it to him. 15th, asked by Raphael Boarman whether his brother, Richard Bennett, did not tell her why he took up Boarmans Enlargement in her name, answered that he told her it would be cheaper and that he had rather the right should lay in her than in his brother Raphael and that she always understood that the land taken up under the name of Boarmans Enlargement was to be divided between her sons, Raphael and Richard Bennett, except the part called Boarmans Help. 16th, asked by Raphael Boarman whether he and his brother, Richard Bennett, did not make use of the above land called Boarmans Enlargement, and get timber off it, previous to his brother's death, answered yes. The deposition of John Edelen, of full age, of CC, deposes that some short time before Richard Bennett Boarman's death, he, this deponent, was walking over the sd Boarmans dwelling plantation with him, and that the sd Richard Bennett told him, pointing towards the land, that he had willed about 20 or 30 acres of his brother, John's land, to his brother, Raphael, in case the sd John Boarman would agree to the will, that he had left about 18 acres of Boarmans Rest and 7 or 8 acres of another tract to his brother Raphael, in order to furnish him with the place on the high grounds to build & to join his brother Raphael's different tracts in the low grounds together, and that he had left all his other lands to his brother, John H. Charles County Land Records 1786-1790; Liber D#4; Page 361. May 30, 1788 from Raphael Boarman and Dorothy, his wife (formerly Dorothy Smith) of CC, to Samuel Hanson, Esq, of CC. Whereas Basil Smith, late of CC, died seized of a tract of land called the Rinkle and Neplew, which was patented to him on Jun 18, 1763, and by sd Basil Smith devised to his wife, Ann Smith, and daughter, Dorothy Smith, and the longest liver of them, during their natural lives, and to the heirs of the body of his ad daughter Dorothy, forever, lying in CC, adjoining a tract of land called Coomes Purchase, containing about 90 acres. Now this deed further witnesses that the sd Raphael Boarman and Dorothy, his wife, for 114 £ 2 shillings, have sold to the afd Samuel Hanson, the afd land. Signed - Raphael Boarman, Dorothy Boarman. We, Walter Brooke and Edward Lloyd Wailes, both of Prince George's County, are bound to Raphael Boarman of CC, in the just sum of 500,000 lbs of good, merchantable tobacco, this Jan 8, 1784, to warrant that sd Brooke and Wailes convey to sd Boarman, all that tract of land on which Aaron Goodrich now lives, called part of Marsh, and cause the rent to be settled, which present tenant now disputes, then the above bond to be void. At the request of Raphael Boarman the following Bond was Recorded this 11th day of June Anno Domini 1793Know all me by these presents that I Mary Ann Boarman of Charles County & State of Maryland am held & firmly bound unto Raphel Boarman of the County & State afsd in the full & Just sum of thirty thousand pounds currency to be paid to the said Raphel Boarman his Heirs Executors Administrators or Assigns to which payment will & truly to be made & done I bind myself my heirs Executors administrators & assigns firmly by these presents signed with my hand & sealed with my seal this ninth day of August Seventeen hundred & ninety two The condition of the above obligation is such that whereas John Hoskins Boarman [with the consent of the above bound Mary Ann Boarman] has exchanged some Land with the above mentioned Raphel Boarman in which Land the above mentioned Mary Ann Boarman has a claim dureing her Single Life Now if the above bound Mary Ann Boarman her Heirs Assigns Executors do & shall for ever peaceably permit & allow this above mentioned Raphel Boarman his heirs
Executors Administrators & Assigns for ever to make use of possess occupy & enjoy the above Lands [without any rent or satisfaction for the same] with al the Improvements & Ca thereon these conditions being compiled with the above obligation to be void else to remain in full power Force & virtue in Law. John Hoskins Boarman (with the consent of sd Mary Ann Boarman) has exchanged some land with the above mentioned Raphel Boarman in which land sd Mary Ann has a claim during her single life. If sd Mary Ann Boarman shall allow sd Raphel Boarman to possess to possess and enjoy the above lands (without any rent or satisfaction for the same), this bond to be void_ If ever requested, this bond is to be renewed under the penalty mentioned in sd bond. On Jun 10, 1774, there was a resurvey made on a tract of land called Boarmans Help, which resurvey, exclusive of Roarmans Help, is by mutual consent, agreed to be divided between sd John Hoskins Boarman & Raphael Boarman, & the division to be made by Cleon Clements & Edward Edelcn, bounded by the head of Hancocks Branch, the beginning of Boarmans Low Grounds, the 2nd line of Boarmans Enlargement amended. The lands ceded to Raphel Boarman by the above are one part of Boarmans Rest & also of ths above resurvey, made on Jun 10, 1774. Cleon Clements & Edward Edelen are to lay off [for] sd John Hoskins Boarman, his part of the land with a line drawn from Benedict Boarman's land across Zachiah Swamp, All the lands below sd line to be the property of John Hoskins Boarman, and the lands above the line, to be the property of Raphel Boarman. Raphael Boarman and John H Boarman are to receive an equal quantity of land, with John H Boarman's land being to the left of the division line. Boarman, both of CC, to divide a tract of land called Boarmans Enlargement, exclusive of Boarmans Help, and to mark several division lines, The division lines involve Boarmans Rest, Boarmans Low grounds, Boarmans Enlargement, and Raphaels Supply. 1st, we adjudge the division to be bounded by the head of Henscocks Branch, a resurvey called Boarmans Meadows, Boarmans Addition, Zachia Swamp, the gutter of Hencock branch.
