Last Will and Testament of Matthias Mitchler
In the name of God, Amen. I, Matthias Mitchler, of the county of Cabarrus and State of North Carolina being in good health and perfect mind and memory thanks be to God, calling into mind the mortality of my body and knowing that is appointed for all men once to die do make, establish and ordain this my last will and testament in manner and form following principally and first of all I give and recommend my Soul into the hands of Almighty God that it and my body I recommend to the earth from whence it came to be buried in a decent Christian burial at the discretion of my executors here after named nothing doubting but at the great day of the general resurrection I shall receive the same again by the almighty power of God, and as touching such worldly estate wherewith it has pleased the Almighty to bless me in this life I give, devise and dispose of the same in the following manner and form.
I give and bequeath to my beloved son David Mitchler the plantation I now live on containing one hundred and forty acres of the old deeded land and likewise a new survey of forty acres joining John Suther and the old tract I give and bequeath to my son David Mitchler and to his heirs and assigns forever the said lands for him to maintain me in victuals and drink and clothes all my life time, sufficient care in sickness and health to maintain me for the said lands without charging the rest.
2nd - I give and bequeath to my beloved son, John Mitchler one hundred and twenty-five acres of deeded land on the west side of Little Cold Water creek joining the land of Walters and Murph's and likewise thirty acres off the old tract whereon he now lives and the creek shall be the line, to him, and his heirs forever for said lands.
3rd - I give and bequeath to my beloved daughter Savilla Shelhoos the sum of twenty shillings to be paid out of my personal estate to her and her heirs forever.
4th - I give and bequeath to my beloved son, George Mitchler, and his heirs the sum of twenty schillings to be paid out of my personal estate to him and his heirs forever.
5th - I give and bequeath all the rest of my estate not heretofore bequeathed and what may be left after my decease to be equally divided amongst my children towit - Catherine Yeoman, Jacob Mitchler, Matthias Mitchler, Mary Burnhard, David Mitchler, John Mitchler, each to receive an equal share to them and their heirs forever.
I do hereby ordain, constitute and appoint my two beloved sons Jacob and David Mitchler executors of this my last will and testament and I do hereby revoke and disannul all other former wills testaments legacys and executors by me heretofore made ratifying and confirming and declaring this and no other to be my last will and testament my will also it that if any of my children or any person for them should attempt to alter or change any clause in this my last will and testament they or any of them offering to do so shall not enjoy or possess to the value of one penny of my estate real or personal in witness thereof I have hereunto set my hand and seal this fifteenth day of February Anno Domine 1806 and in the 30th year of our Independence.
