THIS INDENTURE made the forteenth day of March in the year of our Lord Christ one thousand seven hundred and Sixty five between Tscharner Degraffenried of the County of Lunenburg of the one part and Baker Degraffenried of the County of Charlotte of the other part. WITNESSETH that whereas Barbara Degraffenried the mother of the said Tscharner Degraffenried of the County of Prince George died seized of and in Possession of Sixty Acres of Land be the same more or less in the said County of Prince George on the south side of the Appomattox River including her manor Plantation of which she held in her own right a Fee Simple Estate and by her last will and Testament as to the Records of the said land became fully vested by said will to the said Baker Degraffenried then in his infancy and whereas the said Tscharner Degraffenried did Imediately after the Death of his mother enter upon and take possession of the said land and turn as is and thereupon did sell the same and appropriate to Value thereof to his own use in consideration thereof he the said Tscharner Degraffenried doth by these Presents give grant sell Deliver and Confere to him the said Baker Degraffenried his heirs and assigns forever one certain tract or parcel of land situate lying and being in the County of Lunenburg and Charlotte on both sides of Soeish Creek Containing Twelve hundred and five acres be the same more less bounded as follows Begining at the mouth of the Sawpot Branch thence up the said Branch as it meanders to an area of Oak on the back line Thence along the same North two hundred and Thirty Nine Poles to a red Oak East Four hundred and eighty poles to a Black oak South four hundred and four poles to Pine South fifty one Degrees West one hundred and four poles to a White Oak. Thence a new line North sixty five degrees West Seventy six poles to a White oak on the Spring Branch Thence down the Spring Branch as it meanders to the said Soeish Creek and Thence down the Soeish Branch as it meanders to the first station together will all and Singular the priviledges and appertainances thereupto belonging or in anywise appertaining to him the said Baker Degraffenried his heirs and assigns forever To have, hold, use, occupy, posess and enjoy the same with every part and parcel thereof to him the said Baker Degraffenried his heirs and assigns forever. To the only proper use and behoof of him the said Baker Degraffenried his heirs and assigns and against the claim and demands of all other persons whatsoever shall and will by these powers warrent and forever will defend.

Son of Tscharner and Mary (Baker) deGraffenreid was born 6 aug 1744 in Virginia. He married Sarah Vass. born 1744, daughter of Vinclent and Ann (Rust) Vass. Ann Rust was the daughter of Benjamin and Sarah (Metcalf) Rust of Richmond Co., Virginia. Baker and Sarah deGraffenreid lived in tthat part of LunenburgCo., Va. which later became Charlotte Co. It is believed that most, if not all of their children were born there.

Baker was not mentioned in his fathers will because he died before his father, He did receive his inheritance from his father shortly after his marriage, of 1205 acres of land.

In deed book 10 page 108 Lunenburgg Co.,m Va. dated 14 March 1765 the following record is found:

Between Tscharner deGraffenreid of Lunenburg Co., Va. and Baker deGraffenreid of Charlotte Co.,, Va., Witness: Whereas Barbara deGraffenreid, mother to said Tscharner of the County of Prince George deceased, seized of and in possession of 60 acres of land in Prince George Co. on the south side of Approxmattox River, including her manor plantation of which she held in her own right a fee simple estate and by her last will and testament as the records of said county of Prince George will at large appear, the said land become fully vested by the said will to the said Baker deGraffenreid then his infancy and whereas the said Tscharner deGraffenreid did immediately after the death of his mother enter upon and take possession the said land and premises and did thereupon did sell the same and apropriate the value thereof to his own use, in consideration thereof he, the said Tscharner doth grant to Baker deGraffenreid land in Lunenburg and Charlotte County lyting on both sides of the Swish Creek containing 1205 acres bringing(beginning?) at Sawpit Branch on Spring Branch. 14 Mar. 1765 - Acknowledged by Tscharner deGraffenreid -Gentleman.

The exact time that Baker and Sarah left Virginia and moved to North Carolina is not known. The first record shows that on 3 Nov. 1770, Baker bought 300 acres of land located on the north side of the Dan River in that part of Rowan Co.,m that later became Guilford and still later Rockingham Co. North Carolina. He bought the land from John Sharp for 400 pounds Virginia Currency, described as follows: "One certain tract and parcel of land situated lying and being on the County of Rowan and on the north side of Dan River, containing by estimation three hundred acres be the same more or less and bounded as follows; towit beginning at a Persimonstanding on the said river thence running north two hundred and four poles to a Red Oak, thence west two hundred and twelve poles to a saplin, thence south two hundred fifty poles two hundred fifty poles to a Hickory on the river aforesaid thence down the river to the beginning, and alsso the reversion and reversions, remainder and remainder, rent and services thereof and also the estate right title, interests, preoperty claim etc.

The date of death of Baker deGraffenreid is unknown. Tradition is that he was killed at the beginning of the Revolutionary War. Records prove that he was living in 1775 but had died by 1779. He sold the 300 acres of land he had bought from John Sharp in 1770 to Robert Donald for 500 pounds of Virginia Currency, on 9 July 1775.(deed book 1 guilford Co., Northg Carolina.) On Oct. 20 1775 Baker sold some slaves and farm equipment to his brothers, Francis of Charlotte and William of Lunenburg Co. Virginia.

Sarah, Baker's widow moved to Lunenburg Co., after 1775 and before sept 10, 1779, because on that date,, Sarah as administrator of Baker deGraffenreid, deceased, recovered a judgement aggainst a Joseph Townsend described as follows:

Joseph Townsend - Defendant:

"Same judgement as last for eleven pounds three shillings and seven pence currant money and 376 pounds tobacco and 30 (or 300) pounds tobacco dept and cost in the writ aforesaid mentioned and her cost by her in this behalf expended."

On 13 Nov 1779 Sarah deGraffenreid, widow of Baker deGraffenreid received a grant of 400 acres of land from the State of North Carolina, described as follows:

Deed Book 2 - pages 21 & 94 - Guilford Co., North Carolina.

"To all whom these presents shall come, greetings, Know ye, that we for and in consideration of the sum of fifty shillings for every hundred acres hereby granted paid into our Treasury by Sarah deGraffenreid have given and granted and these present to give and grant to unto the said Sarah deGraffenreid a tract of land, containing four hundred acres, lying and being in our County of Guilford on both sides of Linvils Creek beginning at Richard Sharps corner Black Oak in Turbyfield Barnes's line running then west along his line crossing a branch and the aforesaid Linvils Creek one hundred and sixty-five poles to a Black Oak in James Holderness's line thence along this line north crossing said creek twice three hundred and eighty poles to the first station, as by the platt hereunto annexed doth appear; together with all woods, water, mines, minerals, hereditaments and appurtenances to the said land belonging or appertaining: To hold to the said Sarah deGraffenreid, her heirs and asigns, forever, yielding and paying to us such sum of money yearly, or otherwise, as our General Assembly from time to time may direct. Provided always that the said Sarah deGraffenreid shall cause this grant to be registered in the Register's Office of our said County of Guilford within twelve months from the date whereof, otherwise the same shall be void and no effect."

Witness: Richard Caswell, Esquire, our Governor, Captain General and Commander in Chief, at Kingston, the thirteenth day of November in the Fourth year of our Independence and in the year of our Lord,One Thousand Seven Hundred and Seventy-Nine.

Sarah had moved back to North Carolina, as her eldest daughter, Mary Baker deGraffenreid, married Gideon Johnson Jr. on 18 Nov. 1779. She returned to Virginia a few years later.

On 19 Dec. 1783 Sarah gave her power of attorney to her son-in-law, Gideon Johnson Jr., authorizing him to sell the 400 acres of land in North Car. It was sold to William Lewis for two hundred pounds.

Also Sarah deGraffenreid of Cumberland Co., in the Commonwealth of Vir.:(through and by her power of attorney to her son-in-law, Gideon Johnson Jr.) "To Turbyfield Barnes of Guilford Co., N.C. for 200 pounds all that tract of land in the County of Guilford on the north side of the Dan River:--(Record Book 3 Guilford Co., N.C. 4 June 1785.)

Sarah deGraffenreid also lived in Halifax Co. Vir. for a few years, but soon followed her sons, John, William and Francis to Cumberland Co., Kentucky. She died there in the fall of 1807.

"know all men by these presents that II, John Walsh of Halifax Co. and in the State of Virginia for divers good causes and consideration, hereunto missing have made, ordained, authorized and appointed and by these present do make ,ordained, authorized and appoint Baker Walsh of Summer County, State of Tennessee my true and lawful attorney and in my name and to use, to ask, demand, sell, sure for record and receive of William deGraffenreid of Cumberland County and State of Kentucky all such sum and sums of money, debts, and duties whatsoever which are now due and owing unto me the said John Walsh by and from the said William deGraffenreid(as well for my wife's part of her mother's Sarah deGraffenreid's dower) which the said William deGraffenreid has retained in his hands since the death of Sarah deGraffenreid which happened in the winter and later end of the year eighteen hundred seven as for all matters whatsoever and to have use and take lawful ways in my name or otherwise for and thereof by current distress or otherwise and to agree and compound for the same acquittances or other sufficient discharges for the same for me and in my name to make, seal, and deliver and to do all other lawful acts and things whatsoever concerning the premises as fully in every respect as I might or could do if I were personally present attorneys or more under him my said attorney for the purpose of aforesaid to make, to revoke, ratifying and allowing all and whatsoever myt said attorney shall in my name lawfully do or cause to be done in and about the permises by virture of these present for witness whereof I have hereunto set my seal this 11 day of November 1819.

It has been established that Baker and his wife Sarah(Vass) deGraffenreid were the parents of seven children, their oldest son Vinclent, is the direct line.
