Theodore Russell Reed

Theodore & Cecelia were married by the Rev. James Ellis Reed, MB - Theodore's half brother.
Theodore's parents sold part of their land to him.. The deed cited has a problem with descriptions of the land - seems to be selling overlapping tracts - and doesn't give a total acreage. All of the heirs of his father, John Reed, also deeded property to Theodore - this has been assumed to be the same but it was not - the heirs deeded over 100 acres that had been where John was living at the time of his death. These were different parts of the 300 acres that John Reed's brother Noah had sold to him, as the descriptions are close enough to the original to draw that assumption.
On 19 Jan 1894, John Reed & Jane Reed, his wife, sold to Theodore Reed, land in Madison Co described as: SE 1/4 of NW 1/4 and the N half of said 1/4 of Section 17, T32, R5 East. The land John Reed bought from his brother was in the Northeast 1/4 of Section 17 so that's part of the confusion. Then the description goes on to say the NE 1/4 of the NW 1/4 and the N half of said 1/4 of Section 17 - this overlaps the previous description so definitely something has been transcribed wrong - either into the deed book originall or by the person who abstracted the deed. Some of the land John bought from his brother Noah was in Section 8, not 17 so perhaps that's where the mistake was made. Based on the descriptions, each part would be 120 acres - 40 acres for a 1/4 of a 1/4 and 80 for half of a 1/4 - or a total of 240 acres. This also doesn't come out right with the subsequent deed of the heirs which was for 100 acres. John had bought 300 from Noah, not 340. Of course other portions of this could have changed - John could have bought additional acerage, or sold some. All of the deeds have evidently not been examined. The price to Theodore was $50, which would be very little for 240 acres. Maybe there was just one tract of 120.
John Reed & Jane Reed appeared before C. H. Sharp, JP, and testified that the above was their act and deed. It was filed for record on 24 Mar 1894.
There is no date given when the heirs of John Reed signed over their claim to the 100 acres, known as the John Reed farm where John Reed was living at the time of his death in 1901 to Theodore Reed. I don't know if this date of 1901 was actually given in the deed or is an assumption. The property is described as part of the NE 1/4 and part of the East half of the NW 1/4 in Section 17 and part of the SW 1/4 of the SE 1/4 of Section 8, both in T32, R5. This doesn't match the description of the land previously sold to Theodore. Based on the required signatures, it's fairly obvious that John Reed died without a will. They signed over a period of about five years, so it took awhile to find the heirs. Some of Theodore's siblings were deceased, so signatures of all their living children were required.
I don't know if the signers of the deed actually signed as given here of it the names have been given as known by the transcriber - I suspect the latter. Presumably those signing earliest still lived in the area of Madison Co MO.
